Nvidia only provides the technology and other companies buy the technology and make the cards accordingly, for example the technology goes behind a 8800GT actually purchased by companies like Gigabyte, XFX and make those cards..But also this could be done in 2 ways.. either stick to the reference specification set by Nvidia or the companies may offer non-reference creation of their own but largely they gotta pay license to buy the base technology to Nivida.. or even ATI its the same case! 2.
