    CID to brief court on Swiss Embassy incident today

    The Criminal Investigation Department (CID) will present submissions to the Colombo Magistrate’s Court on the progress of the investigations carried out on the alleged abduction of a staffer of the Swiss Embassy, today (12).

    The said victim has recorded hours-long statements with the CID on three occasions so far.

    The CID mentioned that probes on the purported incident will be proceeded with and the staffer will be summoned again for another statement recording.

    However, according to reports, there is a contradiction among the initial statements made by the staffer in question, the Swiss Embassy and the statement she provided during the interrogations.

    Investigations are also being carried out to uncover as to whether there is an involvement of some external party is behind the incident.

    Travel ban on Swiss Embassy staffer extended till Dec. 17

    The travel ban imposed on Swiss Embassy local staffer, Ganier Banister Francis, was extended till December 17 by the Colombo Chief Magistrate today.

    It was reported that the CID is still in the process of recording a statement from Ms.Francis, who claimed that she was abducted by a group of unidentified men. (Yoshitha Perera)

    Magistrate says no to record statement at Swiss Envoy’s residence

    Declining the request made by President’s Counsel Upali Kumarapperuma appearing for the Swiss Embassy local staffer to record the remainder of her statement at the Swiss Ambassador’s residence, Colombo Chief Magistrate Lanka Jayarathne yesterday directed the Court that the Embassy and Ambassador’s resident comes under Swiss government’s law.

    When the case was taken up in the Colombo Chief Magistrate’s Court, President’s Counsel Upali Kumarapperuma said that his client was not in a suitable health condition to go to the CID and record her statement and requested the magistrate to issue an order to record her statement at the Swiss Ambassador’s residence.

    Explaining the legal background to the request, the magistrate directed the Court that the Ambassador’s residence was also taken as a part of the Embassy and the law will be different in those premises.

    “The Embassy and Ambassador’s residence comes under Swiss law and there will be different laws to such a request,” the magistrate directed the Court.

    The magistrate also noted that the alleged victim could come to the CID to make her statement unless she is having a serious health condition.

    While making his submission on behalf of the Attorney General, Senior State Counsel (SSC) Janaka Bandara informed the magistrate that the alleged victim was still in the process of making her statement.

    SSC Bandara said that the psychiatrist who checked her mental condition requested to refer the alleged victim to a panel of psychiatrists again before submitting the final report.

    Accordingly, the magistrate issued an order to the Chief JMO to take necessary measures to refer the alleged victim to a panel of psychiatrists and constitute a panel for the particular request.

    SSC Bandara further informed that by December 16 the CID and the judicial medical officers are trying to conclude her statement recording process.

    “Based on the medical findings and investigations, I will provide the comprehensive submission on the matter at the next hearing date,” SSC Bandara informed the magistrate.

    Accordingly, the travel ban imposed on Swiss Embassy local staffer, Ganier Banister Francis, was extended till December 17 by the Colombo Chief Magistrate Court.

    Making his submission, SSC Bandara further added that there are certain people who are making unethical and harmful statements to the media representing lawyers and that will be a black mark to the history of Sri Lankan law.

    He also requested an order from the magistrate to the CID to take necessary action to prevent such situations.

    However, the magistrate informed the Court that without submitting specific evidence the Court is unable to issue an order regarding the particular request. (Yoshitha Perera)

    Swiss incident- No evidence of an abduction: CID

    The CID on Thursday informed Colombo Chief Magistrate Lanka Jayaratne that there was no evidence to show any connection to an alleged abduction of the Swiss Embassy employee Garnier Banister Francis.

    The CID in its report said it was revealed from the statement given by Ms Francis to the CID that there had not been an incident near St. Bridget's Convent even though she had told the embassy officials that the alleged incident happened there.

    It said Ms. Francis had informed the CID that on December 8 and 9 that the alleged incident had occurred near the Palmyrah Court Apartment in Kollupitiya

    The CID said according to CID investigations so far, no evidence has been revealed about any incident at No:20,2/2, Palmyrah Court, Palmyrah Avenue, Colombo 03 as claimed by her.

    It said a further statement would be recorded because they needed to be thoroughly investigated.

    The CID said it had been unable to record her full statement on December 8 as she had fainted twice while giving her statement and investigations into the incident are still in progress and that it had not completed recording her statements.

    The CID said during the recording of the statement, the suspect had given her statement in the hearing of the embassy doctor and embassy officials, who were close by and that it needed to record a statement from two other individuals whose names were revealed from her telephone details which includes another embassy official.     Swiss Embassy local staffer arrested

    Swiss Embassy local staffer, Garnier Banister Francis, was arrested by the Criminal Investigation Department (CID) on the instructions of the Attorney General a short while ago.

    She was arrested after being produced in the National Institute of Mental Health.

    The Attorney General advised the CID to arrest Ms. Francis after naming her as a suspect for exciting disaffection against the government.

    Accordingly, she was arrested and produced in the Colombo Chief Magistrate’s Court. (Yoshitha Perera)

    Ambassador of Switzerland in Sri Lanka, Hanspeter Mock, who called on President Gotabaya Rajapaksa today commented on the Embassy staffer incident and said Switzerland harboured no intention to do any harm to Sri Lanka.

    The Ambassador called on President Rajapaksa at the Presidential Secretariat this morning.

    “We wish to work together for the benefit of both countries. Also we need to overcome this situation of tension and to remove any misunderstanding,” the Swiss Ambassador said.

    In response, President Rajapaksa explained to the Ambassador the progress of investigations into the incident so far.

    “It is very well established by now that the alleged abduction is a total fabrication. Irrefutable evidence such as Uber reports, telephone conversations and CCTV footages point to this fact. The Embassy official must have been compelled by some interested parties to bring myself and my government in to disrepute. It is not clear why the alleged victims acted in such a manner,” President said.

    President Rajapaksa said that he saw no wrong in the initial reaction by the Swiss Embassy when this incident was first reported. “It is justifiable. If a member of its staff is in trouble, the Embassy has to intervene”.

    President requested the Ambassador to cooperate with the government to conduct the investigation to its end so that the truth would be emerged.

    Conveying warm congratulations to the President over his recent election victory on his and his government’s behalf, the Ambassador said that he especially appreciated President Rajapaksa’s remark that “he is the President of all Sri Lankans”.

    “Switzerland is happy that traditional relations with Sri Lanka remain strong and mutually beneficial” the Ambassador said.

    First Secretary of the Mission, Sidonia Gabriel accompanied the Ambassador. (Lahiru Pothmulla)

    She was arrested by the Criminal Investigation Department (CID) on the instructions of the Attorney General this evening.

    She was arrested after being produced in the National Institute of Mental Health.
