The Supreme Court, by a majority vote, has granted relief to former treasury secretary Dr. P.B Jayasundara seeking permission to resume office as the treasury secretary. During the hearing six judges approved the move while one was dissenting.
The Bench comprised Chief Justice Asoka de Silva, Justice Dr. (Ms.) Shirani Bandaranayake, Justice (Ms.) Shiranee Thilakawardane, Justice Saleem Marsoof PC, Justice Jagath Balapatabendi, Justice K. Sripavan, Justice P.A. Rathnayake.
The former Secretary to the Treasury made the application seeking to relieve him from an affidavit tendered to the Supreme Court in the Fundamental Rights Application against the Privatization of the Lanka Marine Service Ltd.(LMSL).
The former Secretary to the Treasury filed the motion seeking to relieve him from an affidavit dated October 16, 2008 given to the Court stating that he would not in future accept any offices in the Government. The former Secretary to the Treasury stated in his motion that the President had requested him that his service as the Secretary to the Treasury and the Secretary to the Ministry of Finance and Planing was required in the national interest.
The petitioner, however, stated that the affidavit submitted to the Supreme Court in pursuant to a court order in the aftermath of the delivery of the judgment in the LMSL Rights plea barred him from accepting any office in the Government. (SSS)

End of economic progress for the country for rest of the years.If one checks the recent economic progress in SL, noticeable achievements (Single digit Inflation and interest rates)were in 2004 and 2009 in both instances the learnered Dr. was out of this office. Good Show by the supreme court, Sarath Silva may be cursing after hearing this. Why not reverse the decision giving John Keells what they were enjoying before. PBJ was not ordered to give an affidavit by the Court - they said "he may consider" giving the affidavit. He was under no complusion. he clearly gave the undertaking because he was running scared. He got away with it this time because the SC wished to have separation of powers - Executive & Judiciary. Nevertheless, watch out corruption. Sri Lanka's day of shame! Before long there would be cases filed against the SC judges and who knows they may end up in jail! This govt is carrying on due to its popularity among ordinary people who do not care about the independence of judiciary, economy and international realtions. Yesterday at the UN, both Iranian president and Libiyan dictator spoke and many walked out of the room in protest. We are slowly but surely getting isolated from the rest of the civilized world due our own stupid actions and only the blind supporters of this regime can't see it. In our country former terrorists are ministers and chief ministers while journalists are in jail for writing what they believe. Once people lose the faith on judiciary there will be chaos in the country.

The accquitted must now re-claim the fine. Must re-claim it with interest and a penality for wrongfully being fined. THis will be followed by the CPC hedging fiasco where the senior management was suspended for getting the wrong hedge. De Mell too must be reinstated and compensated for unlawful dissmissal with an apology from the Supreme Court. Howabout Harry J and Susanth R for their part in the crime for so called privatization of LMS an Insurance Corp...What is good for the goose is good for tha gander too and I guess all these folk will seriously think of demanding a 7 judge bench for an appeal...

I do not know the law points behind this case. But I can understand one thing; i.e a person who has been judged by the court as a corrupted person been ameded by the same court as a non courrupted person. The only difference is different judgers, As a citizan of this country, I thought the court is the only place that it has not been courupted. This is a shame on our country.     Think X CJ. He gave some good decision before he retires like watersedge, PB. case, Petrol etc... so immediately government media criticize him.. labeling him as a UNP + Koti kumanthrana yak.. Time will decide.. we should wait. :):cool:

    Like you said X CJ gave very brave and acceptable decisions, when the CBK was the president i thought X CJ was henchman of her, but soon after i realized i was wrong, Mr Silva was a very religious person too, also decisions like Waters edge Petrol and PB should not be changed by the new CJ, at lest as a respect for the gud man, and for not been a henchmen of any one
