  • 7. A woman's testimony counts half of a man's testimony.

The Quran in Sura 2:282 says:
And let two men from among you bear witness to all such documents [contracts of loans without interest]. But if two men be not available, there should be one man and two women to bear witness so that if one of the women forgets (anything), the other may remind her. (Maududi, vol. 1, p. 205).

The foundational reason for having two women witnesses is that one of the women may 'forget' something. This verse goes to the nature of womankind, and implies that a woman's mind is weak.

This hadith removes any ambiguity about women's abilities in Sura 2:282:
The Prophet said, 'Isn't the witness of a woman equal to half of that of a man?' The women said, 'Yes.' He said, 'This is because of the deficiency of a woman's mind.' (Bukhari, emphasis added)

But if two men be not available, there should be one man and two women to bear witness so that if one of the women forgets (anything), the other may remind her.

I think this is bit sexist

ladies emotional, scream faint cries when see a crime.:):):)

Buddy, I work at a hospital. Women bear so much pain without complaining while most men, specially those between 18-65 yrs age range, are dead scared of injections, needles and blood. Many men faint at the site of such.
And many men faint when they learn about the death of a loved one, or information about their own cancer or such severe illnesses.
Emotions are part of being human. How one expresses emotions depends on culture. For example Hindu Tamil people would scream and cry but English people hardly show their emotions.
And women tend to give vivid details of a crime scene, unlike men.

Spot on, being a doctor I have experienced that men are as fragile as women, perhaps bit more even. Women are generally tolerant of pain. Men it variable. Some are shit scared of pain, and some don't give a shit about it. njsa is a typical brain washed Muslim who try to paint women are inferior

I always thought the triumph of inverted feminism was getting women to beleive that silicone implants were cool. But you seem to take the masculine agenda to another level.
Ah! you must be every man's dream. Tell me, how deep is the rabbit hole? Kanpai! as the Japanese would say.

P.S: the rabbit hole is not a sexual reference don't get me wrong.

There are several possibilities for someone to accept a stupid view without questioning and degrade self:
    • Being brain washed
    • Being born without a brain
    • Fearing the consequences of questioning
    • Fearing the unknown
Men and women are not equal; I mean, some of them are men and some of them are women; some of them are in between. But humans are equal and should be treated as such.

Emotions are a feature of higher animals. If someone is unable to feel emotions, they need help of a psychiatrist.

Strength can be measured in different categories: Physical strength; Endurance; Immunity; Charm; Beauty etc. etc. No two people are equal in strengths they possess. The weakest are the ones who perceive themselves to be weak and allow others to manipulate them.

its true there are human and
there are rules where women and man both should follow.
some rules are only for women, and some for men.
women and men are different doesn't mean that their superior to other. don't misunderstand that.
in some parts of the life, should fulfill by men in some by women.they are playing different roles in life and wife cant act like a husband and a husband cant b like a woman. because i follow islam doesnt mean brain washed.we have a brain and know what is correct and wrong. u all think as we are depress.we have our rights and living happily. u look from outside feeling like the same way even we tell ur wrong not ready to agree. who has been brain washed!!!!

njsa, this is not about women being better than men or men being better than women. If I remember correctly you were the one who bought that issue up with women fainting and men being 'gruha mulika'. The gruha mulika argument is absurd because being 'gruha mulika' should not give you special rights infront of the law. I am not even going to go into women fainting.

What is is about is the implications of this quote:

You seem to think there is nothing inherently wrong with it and some of us disagree. And hiding behind the veil of multiculturalism is not going to help you, because this is a universal claim about the competence of women. It says clearly that women are only half as competent as men. You cannot say that is cultural, very much the same way you cannot say pedophilia is a cultural thing. Some things are wrong and misogynistic regardless of cultural disposition. And what is the point of your beliefs if they don't survive close scrutiny.

Testimony of Women (A complete answer)

Allah, the Exalted, stated in the Glorious Qur'an:

(And get two witnesses out of your own men. And if there are not two men (available), then a man and two women, such as you agree for witnesses, so that if one of them (two women) errs, the other can remind her.)

    [2:282]

Allah clarifies to assure the rights of others that testimonies will not be valid unless two men, or one man and two women offer them.

Divine wisdom has granted women, in general, very sensitive emotions, tender feelings, and a predisposition towards care and love of other members of the family. Based on the emotional characteristics of the woman, she might very well follow her emotional inclinations and swerve from harsh realities due to an emotional involvement in a case. A woman's loving feelings might overcome what she has witnessed, and thus she may distort the story of her witness and testimony. Islam asks for two women witnesses against one male because this responsibility is not very suited to their temperament, sphere of interest, and usual environment. At the same time the biological changes that occur in her body due to menses, pregnancy, child-birth and post-natal conditions reduce the sharpness of her memory and may make her forget the details of the issue.

Therefore, a divine precautionary measure was established to eliminate any shortcoming on a woman's part in any case of testimony. We would like to point out here one of the essential principles of the legal and judicial system in Islam, which states that the case is not valid for proceedings if a doubt arises in the case. Therefore, the strength of two female witnesses is intended to eliminate this doubt.

It cannot be used as an argument that there is a general rule in the Qur’an that the worth of a female’s witness is only half the male’s. This presumed “rule” is voided by the above reference (24:6-9), which explicitly equates the testimony of both genders on the issue at hand.

The context of this passage (verse, or ayah) relates only to testimony on financial transactions, which are often complex and laden with business jargon. Besides testimony that involves other people's rights, Islam has granted women full financial freedom in terms of independence and financial decision-making, and made her exactly equal to men in that regard.

It is a false accusation to say that making the testimonies and witnesses of two women equal to one man in certain cases is an insult to the woman's intelligence and a dishonor to her integrity. If that were the case, a single woman's testimony would, likewise, not be acceptable in the other affairs of women. Islamic jurisprudence accepts a woman's testimony in all affairs that are private like in confirming the virginity of a woman, delivery of a child, clarification of female sexual defects, and other matters that mandate examination due to a dispute. At the same time, it must be remembered that Islamic law rejects a man's lone testimony in the least significant financial matters such as lending or borrowing funds and other transactions, since there must be two. The critically serious cases, wherein a woman's testimony must be doubled, is established in order to preserve and prove the rights of individuals in the society based on the reliability and irrefutability of that testimony.

this command shows that Qur'an does not want to make difficulties for women. Note that testimony in the Islamic law in itself is not a privilege but a burden that many attempt to avoid, and for this reason Allah (The Almighty) commanded people to offer their testimonies and not to seek to escape or withhold it. Allah (The Almighty) stated in the Glorious Qur'an:

(And the witnesses should not refuse when they are called on (for evidence).)

    [2:281]

The address here is general for both male and female. Many people all over the world try to avoid becoming a witness, and attempt to escape involvement in offering testimonies, because one is required to go to the court, sit on the witness stand, take an oath to tell the truth, be cross-examined and many other burdens. Financial and physical burdens or threats may result from being a witness and offering testimony. Islam therefore aims at eliminating many of these burdens from the woman, unless she has a partner who witnesses as she does, in matters involving many forms of testimony.

A man's single testimony is not acceptable in financial matters, since there must be two male witnesses to prove the financial right of a claimant, or one man and two women. We have never heard that anyone considered this requirement an insult to man's intelligence or contrary to his rights. This proves that the requirement is for the protection against false accusations and mistakes. There are some cases when the testimony of each is totally equal. For instance, the testimony of a wife is exactly equal to the testimony of her husband when a husband accuses his wife of committing adultery and he has no evidence to prove his claim. Allah (The Almighty) stated in the Glorious Qur'an:

(As for those who accuse their wives, but have no witnesses except themselves, let them present their testimony four times, that by Allah he is one of those who speak the truth. By the fifth (testimony, he invokes) the Curse of Allah on himself, if he is of those who tell a lie (against her) . She will avert the punishment (of stoning to death) from her if she bears witness four times by Allah, that he (her husband) is telling a lie. And the fifth (testimony) should be that the Wrath of Allah be upon her if he (her husband) is speaking the truth.)

  • Allah clarifies to assure the rights of others that testimonies will not be valid unless two men, or one man and two women offer them.
That looks as laughable as existence of Allah.

Based on the emotional characteristics of the woman, she might very well follow her emotional inclinations and swerve from harsh realities due to an emotional involvement in a case.
Show with concrete evidence that men are as twice good as women on this subject. Come on, prove it, you talk of scientifically proven miracles in Quran, so this must be one too. prove scientifically that men are twice good as women in controlling their emotions.

A woman's loving feelings might overcome what she has witnessed, and thus she may distort the story of her witness and testimony.
Once again prove with concrete evidence that men are twice less affected as women in distorting the truth due to loving feelings. Don't run away, prove it.

Islam asks for two women witnesses against one male because this responsibility is not very suited to their temperament, sphere of interest, and usual environment.
Witnessing a rape is a usual environment for a Muslim male? Yeah, may be, especially since what muhammed did to slave women.

At the same time the biological changes that occur in her body due to menses, pregnancy, child-birth and post-natal conditions reduce the sharpness of her memory and may make her forget the details of the issue.
Bollocks. Once again prove this with scientific evidence. Have you ever noticed that there are nearly equal number of male and female doctors? How do you say the sharpness of memory is low in females?

  • 6. A wife may remarry her ex—husband if and only if she marries another man, they have sex, and then this second man divorces her.

The Quran in Sura 2:230 says:

And if the husband divorces his wife (for the third time), she shall not remain his lawful wife after this (absolute) divorce, unless she marries another husband and the second husband divorces her. [In that case] there is no harm if they [the first couple] remarry . . . . (Maududi, vol. 1, p. 165)

The finally and absolutely divorced couple is not permitted to remarry each other unless she marries another man, they have sex, and he divorces her. Sura 2:230 engenders a divorce on the road to a possible reconciliation. Why have the intervening step of a second marriage and divorce before the first couple can work out their differences and get back together?

To see this tragedy in real life, go to this question and answer feature at a traditional Muslim fatwa website. Apparently, a Muslim husband pronounced divorce three times, the divorce is final, and now he regrets his decision made in haste and anger. The cleric or scholar says that they are allowed to reconcile only if she follows the Quranic steps of her marrying someone else, consummating that marriage, and then his divorcing her. As for divorce generally,

conclusion: Islamic divorce favors the man.
