සීම්ස් ලයික් හී කාන්ට් ස්පීක් සිංගල.:sorry: හැබැයි එක දවසක්ඔ ඔය අඩි උස දාගෙන පුස්සිටියේ බක්කියක් අරන් කැඩිච්ච ඉංගිරිස් කතා කර කර ගිය නෝන කෙනෙක් කකුල පැටලිලා වැටුනේ බුදු අම්මෝ ගාගෙන:lol:

මචන්ලා 60 years old uncle කෙනෙක් හැප්පිලා එයාගේ කකුල කැඩිලා. Surgery එකක් කරලා තාම unconscious.මගේ යාළුවා who was driving is in police now. they are going to arrest him.

this uncle who got accident is From Nuwera Eliya and there is no other info about him. the phone he had we called and saw but no body seems to know him.

is there any way we can find more about him?
is it possible to keep my friend out without arresting?
what will be the penalty for my friend?

if anyone had similar experience, please share or at least leave a bump

    your friend is "sort"of lucky in such way that the guy he knocked over doesnt have family.

    ok.. so.. this is going to happen.

    1. police will file a case against your friend on the accident.

    2. His Driving licence will be revoked for a time being and remanded for a minimum of 14 days.

    3. If the "uncle" regains his consciousness, your friend's lawyer can file a motion and get him out of the remand prison before the 14 days.

    4. If the guy is still unconscious, he will be further remanded for a period of 14 - 30 days depending on the "mood" of the benching judge

    5. IF the man wakes up... refer to clause 3.

    6. If he doesnt wake up and die ... your friend's case will be taken up again at the end of the said (clause 4) remand period and will take the form of "reckless driving and murder" ... which goes without saying is an absolute fuckton of BAD !

    7. IF theres no objection from the deceased party, your friend will most probably will receive a stint in REAL JAIL for about a month with probation for about 6 to 1 year depending on how good your friend's lawyer is to talk that over.

    8. IF there's objection from the deceased party... same will happen but the duration will be a bit longer with yet again a longer probation period.

    9. HOWEVER, your friend can contest the case (refer clause 6) sighting things such as may be the deceased party was drunk (if he was) ... or that he was jaywalking in a place where he shouldnt have (yes... theres that option as well) .. or that it was an unavoidable accident that define the very word "accident".. Depending on how good your friends lawyer is on this moment, will either can get your friend out of the jail and back home or make the decision pretty fucking worse.

    10. Either way..., depending on the severity of the accident.. your friends Driving license will be with-held for a judge decided time frame. It could be from 6 moths to 1 year or to life. Also, this ban time starts effect from the date of your friend's release from either the remand prison or the Jail.

    1. Remand jail is not a bad place to be. Its full of normal people who mostly had accidents or mistake or people who were at the wrong place and the wrong time. So chill. .. Being remanded doesnt affect your friend's professional carrier (if hes a state servant) or in things like applying for VISA or residency from other countries.


    2. Going to Jail could be either a blessing or a curse depending on how your friend get on with it during his time inside. It can be a place to make great friends, re-calibrate your view of life OR be someone's dick sucking bitch and a drug addict. ..... SO it depends on how he carry him self if hes unfortunate enough to be imprisoned.

    But then again.. it gives your some MAD fucking bragging rights and some cool ass ideas for Tattoos like his prison number and so on :D :D

    if you are the driver... you would spend sometime in the jail, get your license revoked for a period of time and will have to pay a hefty fine towards the government and compensation towards the dead mans family


    if you are from the dead mans side.... you will get a hefty compensation from the driver or much better if you agree to settle out of courts ... and if the dead man has insurance .. that too you will get immediately after forwarding the court decision.

    It is important to drive safe on the road. It may be due to other person's fault, but still there are lot of accidents that can be prevented if you are careful. It is specially be important to be extra cautious about old and young(children). But that is for future! as an accident had happened.

    First if Police did not grant bail, (which they can) they will produce the Driver to a Magistrate.
    The Magistrate can either remand or grant bail. There is no fixed term as 14 days, but that is the maximum time a Magistrate can remand a person at one time(so it can be extended for periods of 14)
    Such accidents were rare in past and drivers were granted bail in the past but due to huge number of deaths on the road the courts are strict now in serious injuries and fatal injuries.
    Since the injured is unconscious there is a likelihood that the driver will be remanded(as there is likelihood of the person dying and accident will covert to a fatal accident(Penal Code offence))
    But it is important to emphasis the manner in which it happened and who was the at fault on available evidence at that time.(police will file a report(B- report)) The report should include the brief of evidence recorded so far.
    If the Driver was not at fault at all(this is rare, but if his fault was minimal) eg Drunkard pedestrian , suddenly approaching road in night Such things should be stated to the Magistrate before remanding. A lawyer is needed for that, though an accused can speak to the Magistrate directly.
    If the Driver is employed that fact needed to be stated and if he was not intoxicated that can also be stated(since it is a cold area that is essential).
    The speed of the vehicle is also can be stated and whether proper road rules were complied with are factors that are needed to be stated to the Magistrate.
    It is important that Driver is produced to a Magistrate without delay if bail is not granted by the Police.
    There are honest Police officers and they do a honest job. Not that all are corrupt, but they all(most) comply with orders from person in authority including politicians.
    If the Driver is remanded for 14 days an application for bail can be made within that time period and if the condition of the injured had improved generally bail can be obtained within 14 days .(such applicaitons are made by Motions through lawyers)
    It is always good to approach the family of the injured and pay for adequate compensation for the injury.
    I do not think that Driving Licence will be revoked unless there is a high degree of negligence on the part of Driver. This is a last resort by a court for heavy negligence.

    need some bunch of advice regarding this..just read,
    What would happen when I drive along the road at reasonable speed and suddenly I see something just crossing the road.Then I push hard the brake paddle and give my full strength to stop the vehicle.this is the main part...the vehicle which comes behind me and hits right behind mine and the whoever in that vehicle gets seriously injured.
    What would happen to me... ?
