President Sirisena Hits Fresh Snag Over Referendum: Prospects Of Referendum Are Hampered By Several Factors

Although President Maithripala Siriena has explored the possibility of holding a referendum following an unfavourable ruling by the Supreme Court, the prospect of a referendum are hampered by several factors, Asian Mirror learns.

During a meeting at the Presidential Secretariat yesterday, Sirisena has asked leaders of the UPFA to create a positive public opinion about holding a referendum. However, Sirisena did not clearly inform them whether he had decided to go for a referendum in the face of an unfavourable ruling.

It was after this meeting that UPFA MP John Seneviratne went on record saying President Sirisena is considering a referendum on a General Election.

Although there are constitutional provisions allowing the President to hold a referendum on a matter of national importance, there are conflicting views on whether he could hold a referendum on a matter that is deemed unconstitutional by the Supreme Court.

Some advisors to the President have also stated the results of a referendum are not legally binding, and therefore seeking a premature dissolution of Parliament through a referendum could backfire on the President.

ඒ පාර්ලිමේන්තුව විසුරවාලීමට අදාළව නිකුත් කල ගැසට් නිවේදනය ව්‍යවස්ථා විරෝධී බවට ශ්‍රේෂ්ඨාධිකරණය නියෝග කළහොත් ඒ නොතකා කඩිනමින් මහ මැතිවරණයක් පැවැත්වීම විමසා ජනමත විචාරණයක් පැවැත්වීමය.

කෙසේ වෙතත් නීති ක්ෂේත්‍රයේ ප්‍රවීණයන් පෙන්වා දෙන්නේ ජනාධිපතිවරයා ජාතික අවශ්‍යතාවක් දක්වා ජනමත විචාරණයක් පැවැත්වුවත් එයින් ලැබෙන ප්‍රතිඵලය සම්බන්ධව අනිවාර්යයෙන් ක්‍රියාත්මක කළ යුතු යැයි නීතිමය බැඳීමක් නැති බවය. එසේම ශ්‍රේෂ්ඨාධිකරණය විසින් ව්‍යවස්ථා විරෝධී බවට නිර්දේශ කරන ක්‍රියාවක් සම්බන්ධව ජනමත විචාරණයක් පැවැත්වීම විකාරයක් වනු ඇති බවත් ජනාධිපතිට මතුව තිබෙන ජනතා අප්‍රසාදය වැඩිවීමක් හැර වෙනත් කිසිවක් එයින් සිදුනොවන බවද ඔවුන් පෙන්වා දෙයි.

එසේම ජනාධිපතිට හිතුමතේ ජනමත විචාරණ පැවැත්වීමට නොහැකි මෙන්ම ඒ සඳහා අමාත්‍ය මණ්ඩල අනුමැතියක් ද අවශ්‍ය බවටද ඇතැම් නීති වේදීන් කරුණු පෙන්වා දෙයි.

පහත දැක්වෙන්නේ ජනමත විචාරණයකට අදාළව ව්‍යවස්ථාවේ සඳහන් ආකාරයයි.

සිරිසේනට නීති උපදෙස් දෙන්නේ : පොදුජන පෙරමුණෙන්

මැතිසබය විසුරුවා හැරීමට අදාළ නඩු තීන්දුවෙන් පසුව ජනාධිපතිවරයාගේ අභිමතය අනුව මෙම ප්‍රශ්නය ගැන ජනමත විචාරණයක් පැවැත්විය හැකි බවත් ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ 85 හා 86 වගන්තිවලින් ජනාධිපතිවරයාට පැවරෙන බලතල අනුව ඊට අදාළ නියෝග නිකුත් කළ හැකි යැයිද එම නීතිඥ පිරිස පෙන්වා දී ඇතැයිද වාර්තා වෙයි.

මේ සම්බන්ධව ශ්‍රී ලංකා නිදහස් පක්ෂ ආරංචිමාර්ග සඳහන් කරන්නේ ජනාධිපතිවරයාට ලැබෙන නීති උපදෙස් ඉතාම දුර්වල සහ ව්‍යවස්ථා විරෝධී පමණක් නොව ජනාධිපති සිරිසේනගේ දේශපාලන ගමන මුළුමනින්ම අවසන්වීමේ අවධානමක් මේ හමුවේ පවතින බවය.

එසේම මෙම නීති උපදෙස් ලබාදෙන සියළු පාර්ශවයන් මහින්ද රාජපක්ෂ පාර්ශවය නියෝජනය කරන්නන් බවත් ඔවුන් ජනාධිපති සිරිසේනගේ දේශපාලන අනාගතය ගැන සිතීමට වඩා ශ්‍රී ලංකා පොදුජන පෙරමුණේ න්‍යාය පත්‍රය පෙරමුණට ගෙන කටයුතු කරන බවක් පැහැදිළිවම පෙනෙන බවද ඔවුන් සඳහන් කරයි.
