A five judge bench headed by Chief Justice Asoka de Silva hearing a Fundamental Rights petition filed by Gen (retd) Sarath Fonseka against three state media organizations claiming they were biased in reporting events related to the upcoming Presidential elections held the petitioner should first seek remedy through the Elections Commissioner.
The court was of the view that if the Elections Commissioner is not abiding by the rules and regulations of the Election Act, the petitioner could file a writ application in the Supreme Court.
Earlier the court granted permission to file amended papers as this was a matter of national importance. The petition will be taken up on Friday at 2.00 for support.
The other members of the Bench were Shirani Thilakawardena, Gamini Amaratunga, Saleem Marsoof and P.A. Ratnanayake.
