His defence have to prove that he is a psychiatrically ill to the coutrs and that is not that easy, because they'll need an expert opinion from a psychiatrist. Once labelled a psyco case, the stigma is there for the life. Punishments should be given for people who could understand the punishment. That is why the law does not punish children as the adults for the same crime committed. They'll not punish a mentally sub-normal person, gravely ill person who is nearing his death, unconcious patient or a mentally ill patient.
