Wijetunge (Eye Surgeon), Dr. Anoma P. Perera (Anaesthetist) and MaCarthy private hospital Ltd. Colombo 7, have been cited as the defendants. </span><span style="color: black">In his plaint filed through M/s Paul Ratnayake Associates Ltd, the plaintiff said his son Disal was shown to the first defendant in September 2007, seeking medical treatment for tearing from the child's right eye.</span></p><p></p><p><span style="color: black">Thereafter the first defendant Dr. Wijetunge had recommended a minor surgery. Accordingly, on September 30, 2007 Disal Weliwattage was admitted to the MaCarthy private hospital where the surgery was performed by the first defendant along with the second defendant.</span></p><p></p><p><span style="color: black">The plaintiff also said on the said day the child was allegedly operated under anaesthesia. However, the parents were not allowed to enter the operation theatre. </span></p><p><span style="color: black">Fifteen minutes later a medical assistant had come and inquired as to which eye was affected by the illness. Forty minutes later the parents were taken inside the theatre and told that the child was not regaining consciousness.</span></p><p></p><p><span style="color: black">The plaintiff said thereafter he learnt that the child's heartbeat had stopped due to a cardiac arrest. Then the child was transferred to the ICU of the Durden's hospital and warded for nearly a week. Since the child remained unconscious, finally he was admitted to the Lady Ridgeway Children's hospital where he was warded for 1 ½ months.
