U.S.-based sportswear giant Under Armour has obtained an interim injunction from the Commercial High Court of Colombo against Sri Lankan retailer House of Fashions for allegedly selling counterfeit garments bearing its registered trademarks.
According to a Daily FT Newspaper report, the court also issued an Anton Piller order authorizing officials to search and seize suspected counterfeit items from two House of Fashions outlets in Colombo. The court found that House of Fashions had failed to provide credible evidence proving the garments in question were genuine.
“The Plaintiff’s expert verification report unequivocally concluded that the products sold by the Defendant were not original Under Armour merchandise, but counterfeit replicas,” Daily FT reported.
The ruling restrains House of Fashions from manufacturing, importing, distributing, promoting, or selling any goods bearing names or logos identical or confusingly similar to Under Armour’s registered trademarks. (Newswire)
