There were no traces of gunpowder on Parliamentarian Duminda Silva’s hands or clothes and although firing took place within 30 seconds of the confrontation, the distance within which firing took place was 10-30 centimeters. This is revealed by a scar on the forehead of Duminda Silva, President’s Counsel Hemantha Warnakulasuriya told court yesterday.
Warnakulasuriya submitted to court that the above is clearly indicated by the medical report. If the honourable magistrate who named the MP as a suspect studies the same reports he too will take another view of the matter, Warnakulasuriya said.
“The bullet which entered the MP’s head from one side had emerged from other side of the scalp.
If this did not happened, he would have died.
He is the victim of the shooting incident. Unfortunately, he is regarded as a suspect,
Warnakulasuriya said.
“As to whether after Silva was shot at, some others had engaged in shooting is a matter which can be established only if I receive a further record of evidence. Todate, the CID has not taken any action with regard the shooting of MP Duminda Silva. Likewise, his medical report has not been forwarded to court,” Warnakulasuriya said.
Although various sections of the media said that Duminda Silva had fired the first shot according to the medical examination, there was no gunpowder on either his hand or clothes.
Making further submissions Counsel Warnakulasuriya said the distance at which Silva stood could be judged by the position at which he was standing. Accordingly, this disclosed that this distance was around to 10-13 centimeters.
Counsel Warnakulasuriya appealed to court to have the necessary investigation report submitted to him, in consideration of these facts.
Meanwhile, making submission on behalf of the aggrieved party Counsel Tirantha Waraliyadda told court that there is a request to have this incident taken up before a three member Supreme Court Bench.
