Smith's Kid is GOOD if you ask "Kid is BAD or GOOD ? " the question does not imply that which kid you are asking about. You should ask "Is Mr.Johen's kid BAD or GOOD ? " otherwise the Question itself is Incomplete , isn't it ?In the same way If a language has been implemented by two Organizations, say "X.org"  implements Language "P" as open sourced one then later "Y.Com" implements the same language "P" (conformance to original Standards )  as closed source. Then We say "X's P" is Open source language and "Y's P" is Closed source language. For an instance, We all know Activestat Perl is an opensource language right ? if I implement same Perl as a closed sourced language tomorrow , then the Question "Is Perl a Opensource language or not  ?" won't be a valid question.
