Sri Lanka to contest the European Court decision lifting sanctions on LTTE

Oct 19, Colombo: Sri Lanka has decided to contest the decision by the General Court of the European Union (EU)to annul the sanctions placed on the Tamil Tiger terrorist group and will send an envoy to seek support in the union against the ruling.
Sri Lanka's EU Ambassador Rodney Perera is to travel to Strasbourg on Monday to attend the EU parliament's plenary session and to mobilize two key committees, foreign affairs and security and defense, a report by Press Trust of India said.
The European Court, on 16th October,on procedural grounds, annulled the European Council measures maintaining Sri Lanka's defunct Tamil Tiger terrorist group, Liberation Tigers of Tamil Eelam (LTTE) on the European list of terrorist organizations but allowed measures to keep their assets frozen.
The Sri Lankan government expressed concern over the court's decision saying that the judgment requires in-depth study by all the defendant parties which in this case were the European Council and Commission of the European Union, together with two member states, the Netherlands and the UK.
Ambassador Perera is also expected to lobby European Council to challenge the Court's ruling.
The EU General Court in its ruling said an appeal can be brought in the European Court of Justice, which is above the General Court, against the ruling within two months of notification of the decision.
Sri Lanka, while conscious of the fact that the listing of the LTTE is a matter internal to the EU, said it is confident that the European Commission and the EU Member States will take the best possible decision on the future course of action to be taken in this regard, in accordance with their own legal architecture in preserving sovereignty.
Meanwhile, India said the European court's decision has no effect on its ban on the terrorist group but the pro-LTTE political parties in Tamil Nadu have begun to demand the Indian government to lift the group's ban in India.

The Government yesterday said the recent statements by interested parties on the outcome of the case filed by the LTTE at the European Court seeking the lifting of sanctions were based on an inaccurate premise.
Issuing a statement, the Ministry of External Affairs said from the outset of the case being filed the Government of Sri Lanka took action most effectively and provided material of a substantive nature to the defendant and the interveners on a regular basis.
The Government of Sri Lanka said it provided all relevant material to the European Commission in order to assist the Commission to resist the claim by the LTTE.
However, the General Court of the European Union in its 16 October ruling said the contested measures are based not on acts examined and confirmed in decisions of competent authorities, as required by law but on factual imputations derived from the press and the internet.
The Sri Lankan Government said it regards this as a matter of the highest priority and therefore, it has already commenced and will continue to assist the parties to the case in their future course of action, in the interest of protecting its citizens against intimidation through extortion by the remnants of the LTTE and the possible resurgence of terrorism in the country.
