    Switzerland has said it would support Sri Lanka in all measures to investigate and resolve the Swiss Embassy employee matter by due process of law but that the concerned employee still cannot be questioned on health grounds.

    Swiss State Secretary Pascale Baeriswyl, who summoned Ambassador Karunasena Hettiarachchi, has emphasized that the Federal Department of Foreign Affairs (FDFA) would support all measures to investigate and resolve this matter by due process of law.

    “Ms.Baeriswyl confirmed that the employee concerned still cannot be questioned on health grounds, stressing that the individual's health must take priority. She also indicated that while Switzerland had no interest in delaying investigations by the Sri Lankan authorities, the FDFA takes its responsibilities to its staff very seriously,” a statement issued by the FDFA said.

    It said State Secretary Baeriswyl summoned Ambassador Hettiarachchi who is based in Berlin, to Bern in Switzerland following several demarches from the FDFA over the incident concerning an employee of the Swiss embassy in Colombo.

    Ms. Baeriswyl confirmed at the meeting that Switzerland supports measures to investigate and settle this matter through due process of law. However, the employee concerned still cannot be questioned on health grounds.

    In conveying this message, Ms. Baeriswyl responded to a statement issued by the Sri Lankan Foreign Affairs Ministry on December 1, which questioned the embassy's presentation of the facts.

    She also asked Ambassador Hettiarachchi to explain the purported evidence against the events described by the embassy, which the Sri Lankan Ministry of Foreign Affairs had alluded to in its press release.

    She affirmed to Ambassador Hettiarachchi that Switzerland remained ready to take the necessary steps to restore confidence between Switzerland and Sri Lanka.

    “At the end of November, a local employee at the Swiss embassy in Colombo was detained after being picked up from the street and threatened by unidentified men to force her to disclose embassy-related information. The FDFA responded to this incident through a series of demarches. The embassy reported the incident to the Sri Lankan authorities, calling for a swift and thorough investigation to be conducted,” the statement said.

    Alleged victim slapped with ’unofficial’ overseas travel ban

    Following the controversy surrounding the alleged detention of an employee attached to the Swiss Embassy in Colombo, Daily Mirror learns an 'unofficial alert' had been issued at the airport to prevent the victim from leaving the country till the end of investigations.

    A top government source said attempts were underway to fly the alleged victim out of the country due to claims of her ailing health, but the CID was yet to record a statement from her over the alleged detention by an unidentified group last week.

    Although investigations into the complaint lodged by the Swiss Ambassador are underway, the CID said it was yet to gain access to the victim's statement.

    "The alert has been issued to the airport staff as a precautionary measure. It is vital that the victim makes the statement in order to ascertain what exactly happened," the source said.

    A statement by the Foreign Ministry on Sunday night said Foreign Affairs Ministry Secretary Ravinatha Aryasinha together with Defence Secretary Major General Kamal Gunaratne and relevant officials met with Swiss Ambassador Hanspeter Mock and the Deputy Chief of Mission and briefed them on the progress of the probe by the CID.

    The ministry advised that while the embassy had not presented the alleged victim to be interviewed by law enforcement officials despite their request to do so, based on information provided by the Swiss Mission last Friday, the investigation was nevertheless conducted.

    "The ambassador was presented with clear evidence that the sequence of events and timeline of the alleged incident, as formally presented by the Swiss mission to the CID on behalf of the victim, did not correspond with the actual movements of the victim on that date, as borne out by witness interviews and technical evidence including Uber records, CCTV footage, telephone records and GPS data," the ministry said.

    The Colombo Chief Magistrate’s Court today issued a temporary travel ban on the Swiss Embassy employee, who was allegedly threatened by a group of unidentified men, until December 9.

    Sri Lanka’s ambassador to Switzerland has been summoned to Bern to explain a factual dispute over the alleged intimidation of a Swiss embassy staff member in Colombo.

    The Swiss foreign ministry has complained that a local employee at the Swiss embassy in Colombo was held on the street on November 25 and threatened by unidentified men to force her to disclose “embassy-related information”.

    The embassy reported the incident to the Sri Lankan authorities, calling for a swift and thorough investigation.

    On Sunday, the Sri Lankan foreign ministry issued a statement that questioned Switzerland’s presentation of the facts.

    According to that statement, “the sequence of events and timeline of the alleged incident, as formally presented by the Swiss Mission on behalf of the alleged victim to the CID, did not in any way correspond with the actual movements of the alleged victim on that date, as borne out by witness interviews and technical evidence, including Uber records, CCTV footage, telephone records and the GPS data”.

    On Monday State Secretary Pascale Baeriswyl summoned to Bern the Sri Lankan ambassador to Switzerland, Karunasena Hettiarachchi, who is based in Berlin. Baeriswyl asked Hettiarachchi to explain the purported evidence that contradicts Switzerland’s version of events.

    Baeriswyl emphasised to the Sri Lankan ambassador that while Switzerland had no interest in delaying investigations by the Sri Lankan authorities, the foreign ministry takes its responsibilities to its staff very seriously.

    She added that Switzerland supported measures to investigate and settle the matter by due process of law. However, the employee concerned still cannot be questioned on health grounds, the Swiss foreign ministry said in a statement.

    The Colombo Chief Magistrate Court, today, ordered Gallia Barrister Francis, the Swiss embassy local official, who was allegedly abducted, to give a statement to the CID before December 9.

    Colombo Chief Magistrate Lanka Jayarathna also banned overseas travel on the Swiss Embassy female officer Gallia Barrister Francis until she gives a statement.

    Appearing for the CID, IP Ranjith Munasinghe told the court that the Swiss Embassy rejected to reveal the whereabouts of the relevant female officer attached to the Embassy, and also her husband and their two children.

    Meanwhile, Senior state counsel Janaka Bandara told the court that the incident would bring an impact on the country as well if it did not happen on a personal ground.

    He further pointed out that a statement should be obtained from the particular female officer to investigate whether 100% of the content of the complaint is true and whether there is an invisible group operating behind the incident.

    The senior counsel also informed the court that the opportunity to reveal the truth would be lost if the particular female officer leaves the island thereby leaving a black mark on the country.

    Having considered the submission made by the Senior State counsel, the Magistrate imposed a travel ban on the female embassy officer and ordered her to appear before the CID and make a statement.

    The Swiss Federal Court has ruled that the Tamil Tigers are not a criminal organisation and has acquitted 12 people of charges filed by the Office of the Attorney General (OAG).

    In its indictment, the OAG had accused the people of violating the Swiss Penal Code by raising funds for the Liberation Tigers of Tamil Elam (LTTE) between 1999 and 2009. After its nine-year investigation, the OAG suspected the accused of financially supporting the World Tamil Coordinating Committee (WTCC).

    But in June 2018 the Federal Criminal Court found that the hierarchical link between the LTTE and WTCC could not be sufficiently established. The judges also felt there was not enough proof to consider the LTTE a criminal group.

    In April the OAG appealed against the verdict, insisting that the accused had supported a criminal group.

    In a decision published on Tuesday the Federal Court upheld the previous ruling, noting that Article 260 in the Swiss Penal Code was designed to combat organised crime of a mafia nature. Since then it has also been applied to terrorist groups such as al-Qaeda or the Islamic State (IS) terrorist militia. The LTTE was not regarded as a criminal organisation at the time of the fundraising, stated the Federal Court.

    According to the court, those who procured money for the LTTE in Switzerland at that time could not assume that they would later violate the law. Even if it had carried out terrorist attacks, the LTTE’s primary objective was to be recognised as an independent ethnic community.
