අල්ලස් හා දූෂණ කොමිෂමේ නිලධාරීන් 55කට හදිසි මාරු දේශීය 2010 දෙසැම්බර් 31 වෙනි සිකුරාදා, 23:33

අල්ලස් හා දූෂණ විමර්ෂණ කොමිෂන් සභාවේ විමර්ෂණ අංශයේ නිලධාරීන් 55 දෙදෙනෙකුට අද දිනයේ සිට ක්‍රියාත්මක වන පරිදි හදිසි ස්ථාන මාරුවීම් ලබාදී ඇති බව වාර්තාවේ. විමර්ෂණ අංශයේ සේවය කළ පොලිස් නිලධාරීන් 105 දෙනාගෙන් 55 දෙනෙකුට මෙලෙස ස්ථාන මාරු ලබාදී තිබේ.
කෙසේ වෙතත් මෙම ස්ථාන මාරුවීම් ලබාදී ඇත්තේ කිසිදු නීත්‍යානුකූල පටිපාටියකට අනුව නොවේ. මෙලෙස මාරුවීම් ලබා ඇති සියලු නිලධාරීන් විමර්ෂණ කටයුතු සම්බන්ධයෙන් වැඩි පළපුරුද්දකින් යුත් නිලධාරීන් බවද පැවසේ.
සාමාන්‍යයෙන් අල්ලස් හා දූෂණ විමර්ෂණ කොමිෂම සදහා පොලිස් නිලධාරීන් බදවා ගැනීමේදී ඔවුන්ගේ සේවා කාලය සම්බන්ධ තත්ත්ව වාර්තාවකට අනුව බදවා ගැනීම සිදු කෙරේ. නමුත් මෙලෙස ඉවත් කළ 55 දෙනා වෙනුවට බදවා ගන්නා පොලිස් නිලධාරීන් සම්බන්ධයෙන් මේවන තෙක් කිසිදු තක්සේරුවක් සිදුකර නොමැත. එමෙන්ම මේ ආකාරයෙන් කිසිදු වග විභාගයකින් තොරව නිලධාරීන් විශාල ප්‍රමාණයකට ඉතිහාසයේ කිසිදු දිනක ස්ථාන මාරුවීම් ලබාදී නොමැත.
එවැනි තත්වයක් තුළ හදිසියේ සිදුකළ මෙම ස්ථාන මාරුවීම් සම්බන්ධයෙන් බරපතල සැකයක් මතුවේ.

Free rein for bribery & corruption
56 top investigation officers transferred overnight

Dealing another blow to the country’s independent bribery and corruption investigative mechanism, 56 experienced investigation officers including the OIC attached to the Commission to investigate allegations of bribery or corruption, have been transferred overnight from yesterday. Although 56 new police personnel had been sent to the Bribery Commission they could not be appointed as investigative officers or given the responsibility of handling bribery and corruption inquiries as they had not gone through the proper recruitment procedure of the BC. The 56 officers who were transferred were its officer-in-charge Inspector Liyanage, three chief inspectors, six inspectors, 14 sub inspectors, 24 sergeants and eight constables. Most of these officers were moved to the CID, the TID and various other divisions of the police department and they have been replaced by ordinary police officers.


According to senior bribery officials this move would seriously affect future bribery investigations as policemen are seconded to the Commission based on a special recruitment procedure which includes an interview by a panel which includes the Commissioner and the Director General of the Bribery Commission.
Bribery Commission Director General Lakshmi Jayawickrema said the transfer order came from Police Chief Mahinda Balasuriya by way of a fax message.
“When the investigation officers are seconded to the Bribery Commission they have to follow the secrecy clause, take an oath and have to undergo an interview to examine their past record and good character,” Ms. Jayawickrema said. “Otherwise they cannot be involved in an investigation.”
Meanwhile a former senior bribery investigation officer who did not want to be named said, “In special divisions like the CID or State Intelligence Services, bribery investigation officers are a specially trained unit as they have the experience to handle bribery investigations. Therefore transferring 56 experienced investigation officers will definitely affect future bribery investigations.”
Another former senior officer said this is a further blow to the independence of the Bribery Commission.
“Investigation officers have to be experienced and independent as the entire bribery investigation is dependent on their reports,” he said.
“How can you expect an independent investigation against policemen involved in bribery and corruption from the police officers who are only appointed by the police department,” he asked.
Police spokesman Prishantha Jayakody said he was unaware about the transfers but it could be routine transfers that take place every five years and added that bribery investigation officers are sent from the Police Department and as such any police officer can become an Investigation Officer. The Bribery Commission came to standstill on March 29 this year as Commissioners were not appointed after the term of the former Commission had lapsed.
As such no new complaints on alleged acts of bribery and corruption could be entertained or investigated.
The Commission to Investigate Allegations of Bribery or Corruption is one of the independent commissions that came under the 17th Amendment to the Constitution and appointments to the commission had to be made on the recommendation of the Constitutional Council. However, after the passage of the 18th Amendment to the constitution in September the appointment of the commission has to be made by the President. Former Supreme Court Justice Ameer Ismail served as the Commission Chairman while Justice P. Edussuriya and former Police Chief T. I. de Silva were the two Commissioners.
