UN Secretary General Ban Ki-moon dismissed on Tuesday objections by Sri Lanka to his plan to establish a panel to look into possible human rights abuses there and said he would set it up without delay.


Ban told a news conference
he was within his rights to appoint the commission of experts
to probe possible violations during Sri Lanka's civil war
despite a complaint from President Mahinda Rajapaksa
this month that the move was unwarranted.


The UN chief also rejected
as based on a "misunderstanding"
a letter from non-aligned countries

at the United Nations charging
that he was exceeding his authority.

Ban said the appointment of the UN panel accorded with a joint statement with Sri Lanka
issued after he visited Sri Lanka just after the end of the war last May.

"The panel I am establishing will advise me on the standards, benchmarks and parameters
based on international experience that must guide any accountability process
such as the one mentioned in the joint statement," he said.

"I am convinced that it is well within my power as the secretary-general of the United Nations
to ask such a body to furnish me with advice of this nature," he said,
adding that the group would report to him directly.
"This does not in any way infringe on the sovereignty of Sri Lanka."

A statement issued by President Mahinda Rajapaksa's office on March 6
said the panel would be perceived as interference with the campaign
for an April 8 general election and
"would compel Sri Lanka to take necessary and appropriate action in that regard."


Ban said that despite the Sri Lankan objection
and the non-aligned countries' letter there would be "no delay" in the establishment of the panel.
He gave no further details of when it would be set up or who would serve on it.

    Guerrilla wars have never been won by playing by the book.
    Can Prabhaharan testify in a military court for killing innocent civilians?
    Aren't you frustrated with that?

    Definitely there could be war crimes. But they were required to end the blood bath! Army couldn't have killed Prabha if they were playing by the book. In that case, the war would have never finished.

    is another heroic act
    which they should jump at.


    A real hero takes responsibility

    'War Crimes' is a matter of perspective actually.

    Some may consider 'killing a captured terrorist' as a war crime. But it is something 'required' to end the war.

    Geneva Convention was established in 1949 aftermath of World War II. There were no huge threat from 'terrorists' at that time. Only invasive political agendas.

    So Geneva convention might not relevant for the current situation.

    However, Paying for the war crimes is not an heroic act. Because they are Crimes as it is. But the problem is are they really WAR CRIMES?
    OR normal acts which ended war?

    I was stating something earlier in a definite sense which I don't have evidence to prove. So I changed it to align with the current.

    How does one can decide,
    which CAPTURED terrorist should be killed
    to end the war.
    Why,
    Capturing terrorists
    wouldn't be enough to end war.
    If a doctor can cure the wound
    why does the idiot remove the leg?


    Why a Govt commit war crimes
    just like terrorists.

    The answer is
    that they are inhuman.


    That is why intelligent people

    Just think of yourself.
    When you are surrendered to a Govt,
    which has a humane procedure to punish you,
    if it kills you without a trial,
    is it a humane Govt.
    Isn't it a crime.
    Which officer or a soldier,
    even the president can judge you
    when you are surrendered.

    Geneva Convention
    should be more humane now than then.

    Simple.

    Who is more powerful? Who can make decisions?
    An army soldier OR a General?

    Killing all captured terrorists would be inhumane definitely :yes:
    But killing the major decision makers or at least buying them was required to end the war.

    Why do doctors sometimes amputate limbs?
    Because if the leg cannot be cured, then the only way to save the patient is by removing the leg completely.

    Same story here...
    Since the conflict was too deep rooted, there was no way to cure it without cutting the main limb.

    Intelligent people are against them not because of this. They are against because MR doesn't do anything to develop the country and just trying to develop them selves!
