    Bond Scam: Mr. Prime Minister, Facts Are Stubborn!


    CHAPTER 26

    THE HON. PRIME MINISTER’S ROLE IN MATTERS RELEVANT TO OUR MANDATE

    Mr. Arjuna Mahendran was appointed the Governor of the CBSL, on 23rd January 2015.

    Thus, the appointment of Mr. Mahendran was made before the period of our Mandate commenced and we have no jurisdiction to determine the merits or demerits of that appointment.

    However, we cannot be insensible to the fact that, there have been concerns expressed in the public domain with regard to the propriety of Mr. Mahendran’s appointment following reports of his alleged intervention in the Treasury Bond Auction held on 27th February 2015 and his relationship with Mr. Arjun Aloysius who has close connections with Perpetual Treasuries Ltd, which obtained the lion’s share of the Bids accepted at that Auction.

    Concerns have also been expressed in the public domain, with regard to whether the fact that, Mr. Mahendran is not a Citizen of Sri Lanka, made it unlawful or unsuitable for him to have been appointed the Governor of the CBSL.

    Therefore, we decided to briefly look at these issues, though we will not, in view of the confines of our Mandate, venture to arrive at any determination on these issues.

    When Mr. Mahendran gave evidence before us, he stated that, he had been working in Dubai in January 2015 and that, he had received a telephone call from the Hon. Prime Minister, Ranil Wickremesinghe, MP, who had invited Mr. Mahendran to accept appointment to the office of the Governor of the CBSL.

    In these circumstances, the Commission of Inquiry asked the Hon. Prime Minister whether he had invited Mr. Mahendran to accept appointment as the Governor of the CBSL. In reply, the Hon. Prime Minister stated, “Yes. It is correct that sometime in January 2015, I Invited Mr. Arjuna Mahendran to serve as the Governor of the CBSL of Sri Lanka (CBSL).”

    In this connection, we note that, the Hon. Prime Minister is also the Minister of National Policies and Economic Affairs under which the CBSL has been placed.

    Next, in view of the requirements of Section 12 (1) of the Monetary Law Act which states that, an appointment of the Governor of the CBSL has to be made by the President on the recommendation of the Minister of Finance, the Commission of Inquiry asked the Hon. Prime Minister whether Mr. Mahendran was appointed on recommendation made by the then Minister of Finance and/or on a recommendation made by the Hon. Prime Minister, as the Minister of National Policies and Economic Affairs under which the CBSL has been placed.

    The Hon. Prime Minister replied, “Upon the formation of the new Government in January 2015 there was a general consensus within the Government that Mr. Mahendran should be appointed to the post of Governor of CBSL. I discussed the proposed appointment with the then Minister of Finance who agreed that Mr. Mahendran was the most suitable candidate. Accordingly, the then Minister of Finance with my concurrence recommended to His Excellency the President that Mr. Mahendran should be appointed. His Excellency the President acting upon the said recommendation appointed Mr. Arjuna Mahendran as the Governor of the CBSL.”

    Thereafter, the Commission of Inquiry asked the Hon. Prime Minister the reasons why he considered Mr. Mahendran to be a fit and suitable person to be appointed the Governor of the CBSL.

    In reply, the Hon. Prime Minister stated, “Mr. Mahendran was selected for appointment in view of his professional qualifications and experience in the field of banking and investments. He had functioned as the Chairman of the BOI during the period 2002 to 2004. He has also held senior positions in the banking industry in Middle East and Singapore. The previous incumbent lacked comparable qualifications and experience and the administration of the CBSL during his tenure of office had been subject to severe criticism. Hence, prior to the General Election of 2015 there was a general demand from our political allies that a competent person versatile in banking and International finance should be appointed to the post of Governor of the CBSL.”

    In these circumstances, it is apparent that, the question of whether or not the fact that, Mr. Mahendran was not a Citizen of Sri Lanka precluded him from being appointed the Governor of the CBSL was not a “Question of Law”. Instead, it was a “value judgement” which had to be made by those who considered the wisdom of appointing Mr. Mahendran, who was not a Citizen of Sri Lanka, as the Governor of the CBSL.

    In passing, we would also mention that, prior to 2015, the CBSL was placed under the Ministry of Finance. In 2015, the CBSL has been brought under the Minister of National Policies and Economic Affairs.

    That is a decision taken by the Executive which is entirely outside the scope of our Mandate.

    The question of conflict of interest was another matter dealt with in detail by the Commissioner of Inquiry.

    The Hon. Prime Minister said he was aware that, Mr. Aloysius was the Chief Executive Officer and Director of Perpetual Treasuries Ltd and stated that, “When Mr. Mahendran was offered the post of the Governor of the CBSL, I insisted that he should ensure that Mr. Aloysius would resign as a Director of Perpetual Treasuries Ltd and not involve himself in the business activities of that company in anyway. I also strongly recommended that the best course of action would be for Mr. Aloysius to divest himself of his shares in the company. This was conveyed by me to both Mr. Mahendran as well as to Mr. Aloysius. Subsequently, I became aware that Mr. Aloysius had in the month of January itself resigned from the post of Chief Executive Officer and Director of Perpetual Treasuries Ltd. I also became aware that he remained a Shareholder of that company and he intimated that he would divest himself of the shareholdings as soon as possible. On expressing my concerns on this account, Mr. Mahendran reassured me that Mr. Aloysius would not under any circumstances play any role in the business activities of the company. I had every confidence in the assurances given by Mr. Mahendran and as such I had no reason to apprehend that any conflict of interest would be faced by Mr. Mahendran in functioning as the Governor of the CBSL.”

    When the Commission of Inquiry asked the Hon. Prime Minister whether he subsequently inquired from Mr. Mahendran with regard to a potential conflict of interest, the Hon. Prime Minister replied, “I did on several occasions convey to Mr. Mahendran my concerns about a possible conflict of interest arising from his son-in-law Mr. Aloysius having a connection with a Primary Dealer. Mr. Mahendran as set out above reassured me that Mr. Aloysius would not engage in the activities of the company as indicated above. In view of the circumstances, I was confident as set out above that a situation of a conflict of interest would not arise.”

    The Commission after considering all above facts have determined as follows:

    The issue of whether a conflict of interest, in fact, arose as a result of Mr. Mahendran’s son-in-law, Mr. Arjun Aloysius, being closely connected to Perpetual Treasuries Ltd, has been considered in Chapter 25 of this Report. We have determined that, there was a conflict of interest which prevailed during Mr. Mahendran tenure as the Governor of the CBSL because Mr. Aloysius did, in fact, continue to remain actively engaged with the operations of Perpetual Treasuries Ltd, contrary to the assurances which Mr. Mahendran has repeatedly given the Hon. Prime Minister.

    Commission has also expressed the following as a view point in the report:

    We consider that, the confidence which the Hon. Prime Minister states he placed in the assurances given to him by Mr. Mahendran, was misplaced. We are of the view that, the more prudent course of action would have been for the Hon. Prime Minister to have independently verified whether Mr. Mahendran was, in fact, honouring the assurances he gave the Hon. Prime Minister. We regret that, the Hon. Prime Minister did not take that course of action.

    The Hon. Prime Minister’s act of appointing an Investigation Committee of his choice has been critically viewed by many including the Members of Parliament. The Commission has stated as follows:

    We consider that, the position may have been different if the Committee or other body which carried out this Inquiry had the benefit of members who had knowledge and experience in the technical and practical aspects of the matter being inquired into.

    Commission has made the following observation about a statement made by the Prime Minister in the Parliament on 17th May 2017.

    Next, with regard to the Statement made in Parliament by the Hon. Prime Minister on 17th March 2017, in which he states, inter alia, that, Mr. Mahendran had not interfered in the Treasury Bond Auction of 27th February 2015, we have held that, the evidence establishes that, Mr. Mahendran and Deputy Governor Samarasiri, deliberately and mala fide, misled the Hon. Prime Minister and suppressed material facts and misrepresented the factual position when they reported the events relating to the Treasury Bond Auction held on 27th February 2015, to the Hon. Prime Minister and also when they submitted a Briefing Note to the Hon. Prime Minister, with regard to the events of that Auction.

    While we do not, for even a moment, presume to make any pronouncement on events that transpired in Parliament, we consider that, the Hon. Prime Minister would have been better advised, if he had independently verified what had happened at the CBSL on 27th February 2015, before making any statement, instead of relying on the Briefing Note and report submitted to him by Mr. Mahendran and Deputy Governor Samarasiri.


    Now the country is awaiting to see who would take the responsibility for

    1. The fleeing away of Arjun Mahendran

    2. The accusations, allegations against MPs some of which have been admitted by MPs and Ministers for accepting gratifications from the principal accused parties of the scam.

    3. For the colossal loss to the CBSL and to the continuing adverse effects to the economy of the country.

    4. The various recommendations made by the Commission against several parties for the need of initating legal action. Eg. The former Minister Ravi Karunanayake.

    5. The fate of upright, conduct and behavior expected by the voters who elected these people under a democratic system to uphold and maintain principles of good governance.

    6. The statement of the Prime Minister to the Parliament without verifying the facts independently.

    ADB to give Sri Lanka US$ 3 billion loan for infrastructure development - Finance Minister

    May 09, Colombo: The Asian Development Bank (ADB) has promised a loan of US$ 3 billion to Sri Lanka for infrastructure development, Finance Minister, Ravi Karunanayake has said.

    The loan agreement has been reached during the 49th Annual Meeting of the Asian Development Bank Governors held in Frankfurt, Germany from 2-5 May, according to a report in state-run Daily News. Sri Lanka's Finance Minister participated in the discussions with the lender at the meeting.

    In addition to the US$ 3 billion loan, the ADB will grant US$ 200 million separate aid for the development of Small and Medium Enterprises (SME) sector.

    The loan facility given under a concessionary interest rate will be given to Sri Lanka over the next three years Minister Karunanayake said.

    The funds will be allocated to some of the main development projects in the country and will be channeled to develop new railways, port development, electricity distribution network, and highways and transportation systems, according to the Minister.

    The ADB annually lends Sri Lanka about $ 400 to 500 million, however this loan is in excess to this annual amount.

    The lender has also agreed to lower the interest rates on current loans to Sri Lanka, the Finance Minister said.

    "The ADB has decided to lower the 7 to 8 percent interest rates on loans and bring it down to 1½ to 2 percent, which is a significant achievement," he said adding that the ADB has pledged to give its fullest support to ensure that the development funds are channeled to Sri Lanka.

    He added that during the past eight years, there was an absence of such funds and to see it with renewed vigor means that this money can be spent on development.

    The Minister added that Sri Lanka has received the distinctive opportunity to participate in the first round of discussions, where the specialty of Sri Lanka in the Asian region and the changes that have taken place in the country were focused.

    MONORAIL PROJECT: PROPOSALS TO BE PRESENTED TO CABINET

    The monorail project between Colombo and Malabe is back on track with the Ministry of Megapolis and Ministry of Transport finalizing the proposal that is to be presented to the Cabinet. Megapolis Authority Director General Lakshman Jayasekara said the proposal was signed by both Ministers and was to be presented to the Cabinet soon. “Once approval is granted we can start construction within nine months and complete the project within three years,” he said.

    When the Daily Mirror inquired into the project previously, during the 100-day programme, the Transport Ministry said the project was most likely to be scrapped. Transport Minister at the time Ranjith Madduma Bandara said the project was “too expensive” and that the ministry was considering an electric train service. The project which was to be funded initially by the Japan International Cooperation Agency (JICA). The project was aimed to combat the increasing traffic flow in the city and the urban areas. Previous reports stated that USD 55-57 million was the estimated cost per km for the monorail project. Previous media reports stated the rail track would be initiated from Malabe, Talahena, Robert Gunawardena Mawatha, National Hospital, Union Place, World Trade Centre, Colombo Fort and end at Kotahena. In an analysis, JICA said that poor public transportation and road network and the increasing number of vehicles that enter the city were the main cause for rising traffic congestion.

    BIA Stage Two ready for tender

    The much awaited US$ 500 million Stage 2 development of the Bandaranaike International Airport (BIA) will get underway soon.It is expected to be completed by end 2017.

    The tender for the “Package B – Remote Apron and Taxiways” will be announced shortly in the print media.

    The airport will be partially closed from January 2017 for urgent runway repairs.The airport will be closed for about six hours from 9.00 a.m. for a period of three months.

    SriLankan Airlines CEO Suren Ratwatte told the Daily News that they have been informed of this development.This will create major problem for SriLankan since 30 percent of their aircraft land and take off during this time.

    Under the BIA development project, capacity of the airport will be enhanced by a further 9 million passengers per annum and on completion, handling capacity of BIA will be increased to 15 million passengers per annum.

    The scope of the project consists of construction of a new multi-level terminal building (Terminal 2) with a floor area of 180,000 sqm, where arrivals and departures are separated vertically, consists of two pier buildings, Pier 2 and Pier 3. The new terminal will be designed for the provision of barrier free access with many environmentally friendly initiatives.

    Concessionary Loan Agreements for this development was signed between Airport and Aviation Services (Sri Lanka) Ltd. and Japan International Cooperation Agency (JICA) for the funding of Stage 2 of Phase II Development of BIA.

    BIA which has a handling capacity of 6 million passengers per annum handled 8.5 million passengers in 2015.

    “Package B – Remote Apron and Taxiways” comprises of apron to an extent of 210,000 m and taxiways of 17,000 m. The existing apron has 25 parking stands which includes 8 contact parking positions and 17 remote parking positions.

    Additional 23 aircraft parking positions will be developed under BIADP II-2, which includes 16 contact gates.

    On completion of the project, BIA will have 48 parking stands in total of which 24 contact parking positions, 24 nos. of remote parking positions.These parking positions will be provided with Fuel Hydrant Points by the Ceylon Petroleum Corporation.

    BIA which has a handling capacity of 6 million passengers per annum handled 8.5 million passengers in the year 2015.

    The airport development will be a major boost to the Sri Lankan tourism industry and it would also provide additional employment.

    Land for Sri Lanka Volkswagen assembly plant secured: BOI

    Apr 11, 2016 (LBO) – Sri Lanka’s Board of Investment has helped to secure land for the setting up of a Volkswagen assembly plant, the investment promotion agency said.

    “Through the successful facilitation by Upul Jayasuriya, chairman of the Board of Investment of Sri Lanka and his officials, working closely with the Ministry of Lands, land in the Kuliyapitiya area was secured for setting up the Volkswagen assembly plant in Sri Lanka,” the BOI said.

    “This land will be taken over by the BOI and would be formally handed over by the investment promotion agency to M/s Senok Automobile (Pvt) Ltd., for the assembly of cars manufactured by Volkswagen AG, the renowned German Company.”

    The agreement to assemble cars was earlier signed by Jayasuriya and Noel Selvanayagam, president of Senok Automombiles.

    A BOI Section 17 Agreement, the investor will assemble vehicles in the 1000 cc to 2000 cc category and these vehicles will be diesel powered and include passenger cars, Sport Utility Vehicles (SUV), Multi Utility Vehicles (MUV) or commercial vehicles.

    Initially these vehicles would be marketed locally for a period of 3 years and thereafter to overseas markets, according to the project.

    There is also potential to export petrol/electric/ hybrid vehicles built without the concessions given for assembling diesel vehicles.

    “The total value of this project is an investment of 26.5 million dollars of which 21.5 million will be invested in fixed assets within a period of 24 months.”

    BOI is very keen to attract other leading automobile manufacturers into the country as the industry creates opportunities for the creation of local component manufacturers that can supply the building of a complex product such as passenger car, it said.

    “The uniqueness of the project would be the inflows of German advanced automobile technology into the country and creating of job opportunities for the local youth.”

    Sri Lanka port city becomes financial city, new deal by August: PM

    Japanese funds for light rail transit (LRT) system and elevated highway


    June 17, 2016 (LBO) – Sri Lanka’s port city construction will be converted to a financial city with a new agreement which is expected to be signed by August with the China Harbour Engineering Company, the Premier said.

    Officially announcing the lifting of EU fishing ban, Prime Minister Ranil Wickremesinghe said the port city land will be given on a 99-year lease basis.

    “We will convert the port city to a financial city filling the gap between Singapore and Dubai,” Wickremesinghe said.

    “This financial city will offer services such as financial, trade and legal matters.”

    Deputy Minister of Megapolis and Western Development Lasantha Alagiyawanna told Parliament recently that the Prime Minister has already appointed a committee to look into the possibility of formulating a new agreement for the project.

    The 5-member committee comprising of secretaries is headed by the secretary to the Prime Minister.

    Prime Minister added the government wants to finalize the Hambantota dockyard project with the China Harbour Engineering Company before September this year.

    Development plan of the Hambantota industrial zone project will also be finalized in the near future.

    Prime Minister said the Japanese funds will be available for the implementation of the light rail transit (LRT) system and elevated highway for Sri Lanka’s capital Colombo.

    After moving Welikada prison to Kalutara district, a new commercial city will be built using the space, he further said.

    US resumes Millennium Challenge aid to Sri Lanka

    ECONOMYNEXT – The United States has approved resuming Foreign Military Financing and Millennium Challenge Corporation aid to Sri Lanka, which had been suspended after last year’s political crisis, Minister of Finance Mangala Samaraweera said.

    “Recently, the US government approved the Foreign Military Financing as well as the Millennium Challenge Corporation Compact Programme for Sri Lanka, which was put on hold,” he said at the opening of a US aid facility in Matara.

    “We are looking forward to a new team coming to Sri Lanka next month and I’m hoping that the board meeting to be held in March will decide to give us that elusive compact again.”

    Assistance offered through USAID, US Peace Corp and the House Democracy Partnership Programme are some the initiatives the two countries are working together on, Samaraweera said at the opening of a new ‘American Corner’ in Matara.

    It will offer free training in a partnership with the Matara Chamber of Industry and Commerce to expand economic opportunity for people in the southern region.

    Through the Millennium Challenge Corporation (MCC), a U.S. government aid agency, Sri Lanka will get grants for projects in the transport and land sectors.

    Sri Lanka to further simplify company registration

    ECONOMYNEXT – Sri Lanka will further simply company registration procedures with refors that will enable applicants to get more done through the registrar of companies, an official connected with the process said.

    The government will do away with the need for a public notice in registering a new company, said Champika Gunaratne, project manager of the Information and Communication Technology Agency.

    “We are changing section 91 of the companies act to remove the procedure of a business start up being required to have a public notice, which takes three days now,” he told a forum on reforms to improve Sri Lanka’s ranking in the World Bank’s Ease of Doing Business Index.

    “They will also have no need to go to the Inland Revenue and Labour departments. All three can be done through the ROC (Registrar of Companies) which will notify Inland Revenue and the Labour Department and get registration in two hours.”

    The new reforms will happen within one month.

    Sri Lanka to launch e-health cards to boost state health sector

    COLOMBO, Feb. 28 (Xinhua) -- Sri Lanka's Health Ministry will introduce e-health cards by the end of this year, which will uplift the country's free state health sector, local media reported Thursday.

    Health Minister Rajitha Senaratne said the e-cards will include all the health information of an individual citizen which will make free health care easier at the state hospitals.

    Under the project, a complete medical report of a citizen which includes the blood group, medical history and details of the three last visits to the doctor or hospital, weight and body mass index and other bio metric data will be stored in the e-card.

    "Any doctor, in Sri Lanka or overseas, can immediately provide treatment to a patient with the help of the e-card in case of an emergency or if the patient is unconscious," Senaratne said.

    "We strongly advise all citizens to have the e-health card with them all the time to prevent any risk to their lives in the event of an accident or serious ailment," he added.

    The e-health card project will be implemented at a cost of 65 million euros (74 million U.S. dollars) and it has already been lunched as a pilot project in Beruwala, in southern Sri Lanka and Kalutara and Bandaragama, in western Sri Lanka.

    Further, all state hospitals will be equipped with the necessary technology to access all the health information of an individual citizen through the e-card.

    "I hope with the introduction of the e-health card this year, our free health care delivery system will be revolutionized in par with that of any developed country," the minister said.
