New legislation to unmask online trolls and make social media companies responsible for comments

The legislation will deem social media companies the publisher of defamatory comments while Australian courts will have the power to unmask the online trolls making defamatory comments.

Nonsense. Demasking was possible even before that. Your identity a one subpoena away.

    :D

Once you demask the person, you can sue the person which is what I did and now my trolls are my best buddies :D

Could they still hide behind a VPN?
VPN can be subpoenaed or they are out of business :D

If they really delete logs, you can subpoena the upstream host of VPN company.

    Who gives a shit
This is practical to a certain extent, but what if a troll from Russia posts a degrading comment to someone in New Zealand? How would things work out then?

In this case, both governments should have a mutual accord on such issues and I don’t see Russia agreeing on such a thing in the near future.

Depends on how you register users to your site ponz. If you use legitimate means to verify your identity (eg: phones and shit) then tracking is easier. Else it can be quite difficult.

Subpoena will only give you the legal right, but will be tough to prove who it was if there was no proper method of proving who it really was

    There is something called "non-repudiation"

Nonsense. All you need is an IP and ISP take care rest. Even if you used a prepaid sim, ISPs can give Geolocation details for subscribers.

From geolocation, one can observe CC TV camera or ask people :)

Ponz, explain someone behind a corporate proxy. All you can do is ping point the IP and you cannot tell who actually did it cos everyone in the company will be using the same IP

Well if that's the case, you can subpoena Google or Mozilla and get the MAC address for the user. All you need is time stamp and IP address. Once you receive mac address, you can request company to provide details who use the machine.

I don't think that you know much about networking/cyber security and shit. Private IPs and MACs aren't globally unique.

Go google and search for this "non-repudiation". Read that and then read what you have put here again ;-)

    > non-repudiation

Nothing in real world is based on non-repudiation. You can't have lawful non-repudiation ever and it is not practical :D

    > I don't think that you know much about networking/cyber security and shit.

How do you know? If I were to make a Linkedin profile, it would be a huge one.

It looks like you don't know a shit about the power of Law Enforcement and you're in denial :D

    > Private IPs and MACs aren't globally unique.

While they are, they can be unique to an organization.

    > Private IPs and MACs aren't globally unique

I talked about public IPs not private IPs.

Let's assume the troll is tharakaf. tharakaf is trolling King Sultan on Elakiri.

Police request IP and User Agent, Last Login Timestamp details for user "tharakaf" from Elakiri.

Elakiri send details to the Police.

Turns out, tharakaf's user agent is Chrome and IP is 203.115.27.68.

This IP 203.115.27.68 belongs to Kells Sri Lanka.

Since the IP is a corporate proxy, we have to request details from Google. We subpoena Google and supply them whatever we have on the suspect, they find a match and send a record to us.

The Google records typically includes the Mac Address, Internal IPs, Network Card Details of the user.

We then subpoena Kells Sri Lanka and supply them the info (Google Records, Elakiri Records). They will provide the details of the actual user then.

    Voila! Case closed.

    :ROFLMAO:

Ponz, MACs only need to be unique in a single broadcast domain because it works on L2. Private IPs also can be duplicated in the same organization and manged using NAT (not recommended cos it makes shit complex)

So even if you manage to find my private IP from the Keels (say there were 2 people who trolled you on EK at the same time), how are you going to say it was me and only me who did?

Also Proxies don't record MACs (only usernames/IPs) and I don't think that google tracks the MAC cos it is actually useless to store it cos it has no value.

And finally "Non-Repudiation" means the person cannot deny that it was he who did it. In this case they can easily dispute since the shit isn't unique.
