EPF and ETF forgery (In Sri Lanka)

    Any idea about the companies who don’t actually follow the EPF and ETF procedure? for example i know a company who deduct from employee each month the amount for EPF and also includes everything about it in the pay sheet but doesn’t really send it to Labour department. a friend of mine worked here and when he decided to resign he found that even though they have deducted sum amount from the Salary saying EPF. When he checked at Labor department he had no money received in to his account.

    How can somebody handle this kind of a situation? i have heard that EPF and ETF is a must for the companies who are under shop and office act.

    Any advice would be highly appreciated.

    කොම්පැනි නෙම්යි බන් දැන් ETF,EPF හොරා කන්නේ.. ලොකුම හොරා ආන්ඩුව. උන් ශ්‍රමිකයන්ගේ සල්ලිවලින් හෙන්චයියන්ගේ බන්කලොත් කොම්පැනි ගොඩ දානවා..

    In the event of Underpayment or Non payment of contributions, the employee reserves the right to make a written complaint to the Commissioner of the Labour. On receipt of the complaint and after proper investigation the Employer will be informed and warned to pay the dues.
    If the Employer doesn’t fully co-operate and pay the contributions after three warnings, the Labour Department will be forced to take Legal Action against the Employer to safeguard the rights of the Employee.

    Put a complain.

    you can go to a labor tribunal for industrial disputes
