Can not do.

Legally yes. Child can stay. But parents doesn't get the chance.

Imagine if you commit a crime with infant at home waiting for you. Would a judge spare you because you have an infant at home ? No. You and infant will be separated and you would be treated as a criminal if convicted.

Child can stay. Parent will have to leave. This is not something to be looked at humanely.
