1. ඔබ පාරෙ ගමන් කරන විට, තනි පොලිස් නිලධාරියෙක්ට ඔබව නැවැත්වීමට තහනම්. එසේ නැවැත්වීමට උත්සාහ ගතහොත්, නොනවත්වා යාමට ඔබට හැකිය.

2. තනි පොලිස් නිලධාරියෙකුහට ඔබේ රියදුරු බලපත්‍රය රඳවා ගැනීමට නොහැකිය.

4. තනි රථ වාහන පාලක පොලිස් නිලධාරියෙකුට (Traffic Police) ඔබට දඩ ගැසීමට හෝ චෝදනා කිරීමට නොහැකිය. ඔහුට අනිවාර්යෙන්ම සාක්ෂිකරුවෙකු අවශ්‍ය වේ. සාක්ෂිකරු පොලිස් නිලධාරියෙකුම විය යුතුයි. (එබැවින් සැමවිටම පාරේ රථ වාහන පාලක පොලිස් නිලධාරින් දෙන්නෙක් එකට සිටියි)

5. පොලිසිය යනු සාමය ආරක්ෂා කිරීමට කැපවුන බලකායකි. ආයුධ සම්පන්න බලකායක් නොවේ. ඔවුන්ට බැටන් පොල්ලක් හැර වෙනත් ආයුදයක් ලඟ තබාගැනීමට නීතියෙන් තහනම් කොට ඇත. (නමුත්, පැවතුන යුධමය තත්වය නිසා, යුද්ධය අවසන් වනතුරු ඔවුන්ට තුවක්කු ලබාදීමට අධිකරණයෙන් නියෝග කර තිබිණි.) එමනිසා පොලිස් නිලධාරියෙක් ඔබට තුවක්කුවක් දිගු කලහොත් ඔහුට විරුද්ධව පැමිණිලි කිරීමට ඔබට අයිතියක් ඇත.

6. පොලිස් නිලධාරියෙකු ඔබට "බීමතින්" රිය පැදවූ බවට චෝදනා කලහොත්, බැලූන් පරීක්ෂාව (Balloon Test) කිරීමට ඉල්ලා සිටිය හැක. ඒ අවස්ථාවේදී ඔවුන් සතුව බැලූන් නොමැති නම්, ඔබට යාමට අවසර ඇත.

7. මහ මග ගමන් ගන්නා වාහනයක් නැවැත්වීමට අවසර ඇත්තේ රථ වාහන පාලක පොලිස් නිලධාරියෙකුට (Traffic Police) පමණයි.. (ඒ බැවින් හමුදා මුරපොල (check point) වල එක පොලිස් නිලධාරියෙක් හෝ සිටිය යුතුය.)

8. පොලිස් නිලධාරියෙකුට ලිඛිත උසාවි නියෝගයක් නොමැතිව ඔබේ නිවසට හෝ රැකියා ස්ථානයට ඇතුළු විය නොහැක. ලිඛිත නියෝගය ඉල්ලා සිටීමට ඔබට සියලු අයිතිය ඇත. ඔවුන් බලෙන් ඇතුලු වීමට සැරසෙයිනම් එයට විරුද්ධ වීමට ඔබට අයිතිය ඇත.

9. ඔබ සිදුකල වැරැද්දේ ස්වභාවයත්, දණ්ඩ නීති සංග්‍රහය අනුව අදාල නීති උල්ලංගනය කිරීමත් පිලිබඳව කියන තුරු රථ වාහන පාලක පොලිස් නිලධාරියෙකුට (Traffic Police) ට ඔබේ රියදුරු බලපත්‍රය ලබාගත නොහැකිය. එසේ සඳහන් කිරීමට අපොහොසත් වන්නේ නම් ඔබට යාමට අවසර ඇත.

10.රථ වාහන පාලක පොලිස් නිලධාරියෙකු (Traffic Police) ඔබේ බලපත්‍රය බලෙන් ලබාගෙන, එය නැවත ලබා ගැනීමට පොලිස් ස්ථානයට එන ලෙස පැවසූ විටක, එලෙස නොගොස් පොලිස් අධිකාරියතුමන්ට හෝ ප්ප්‍රදේශිකයට අදාල නියෝජ්‍ය පොලිස්පතිතුමන්ට පැමිණිලි කිරීමට ඔබට අයිතිය පවතී. එවිට අදාල නිලධාරියාව, දුරාචාරය සහ නොහික්මුණු හැසිරීම යන වරද මත පදනම්ව සේවයෙන් පහ කරවීමට වුවද හැකියාව පවතී.

11. කාන්තාවකගෙන්,පොලිස් නිලධාරියෙකු නම, ලිපිනය, හැඳුනුම් පත, දුරකථන අංකය ඉල්ලා සිටී නම් ඒ ඉල්ලීම ඉටු නොකිරීමට අයිතිය ඇත (ඔහු ඔබට හිරිහැර කිරීමේ අරමුණින් සිටින බව ඔබට හැඟේ නම් පමණක්). ඔහුට ඔබව (කාන්තාව) අත් අඩංගුවට ගැනීමට නොහැක. ඔබට පොලිස් නිලධාරිනියකගේ සහය ඉල්ලා සිටීමට අයිතිය ඇත.

12.පොලිස් නිලධාරියෙකු කාන්තාවක් පරීක්ෂා කිරීමට බව පැවසූ විටක, එය පොලිස් නිලධාරිණියක ලවා කරවා ගැනීමට ඔබට (කාන්තාව) අයිතිය ඇත. පොලිස් කාන්තාවක් නොමැති නම්, ඔබට එය ප්‍රතික්ෂේප කිරීමට අයිතිය ඇත.

14. ඔබ කිසියම් කරුණක් මත අත් අඩංගුවට පත්ව සිටිනම් පොලිසියට ප්‍රකාශ ඉදිරිපත් කිරීමට ප්‍රථම නීතිඥයෙකුගේ උපදෙස් ලබාගැනීමට ඔබට අයිතියක් පවතී. එනිසා එවැනි අවස්ථාවල ඔබට නීතිඥයෙකු ඉල්ලා සිටීය හැකිය.

The following is a rejoinder from the Traffic Police Headquarters to an e-mail circulating via the Internet, straightening out the facts.

1. A single cop cannot stop you on the road!

(It’s prohibited and you are not suppose to Stop either!)

Answer Incorrect- The Motor Traffic Act of 1951 and amendments to the Act thereafter, do not specify the number of policemen required to order a motorist to stop. Any police personnel is empowered to stop any vehicle and it is not restricted to offences under the Motor Traffic Act. Vehicles can also be stopped by police for any investigational purpose.

2. A single cop cannot seize your driving license!

Answer Incorrect. Under section 162 of the Motor Traffic Act (MTA), a driving license could be taken charge of by a policeman in uniform for violating offences under the MTA as well as certain offences prescribed in the Penal Code.

3. Only a ‘traffic control’ cop has the authority to request anything more than your NIC when you are behind wheels.

Answer Incorrect- Any policeman in uniform could examine the driving license, revenue license, insurance certificate and, or, any other document pertaining to the operation of the vehicle.

4. A single traffic cop can never press charges against you. He must have a witness if he does so.

5. That’s why you always find ‘two’ cops together.

Answer Incorrect- Deployment of policemen is decided by respective officers in charge depending on their requirement and the availability of resources.

6. Police is a peace controlling force, not an armed force!!! They are prohibited by law to carry anything more than a baton! (but due to the prevailing war, they are issued guns by a supreme court ruling, till the war ends)

7. So, if a cop pulls a gun on you, you can sue him!!!

8. If a cop claims that you are drunk, you have the full right to ask for a ‘balloon test’. if they do not have it in their possession on the time of your request, you can go.

Answer Incorrect- A breathalyzer test is not mandatory in the event of the non-availability of a breathalyzer test, police may produce a suspect driver before the nearest government medical officer for an examination. Under MT 155 (1) (e), any person who refuses to submit himself or herself to such an examination shall be presumed to have been driving under the influence of alcohol or prohibited drugs.

9. Only traffic Cops have the right to stop any moving vehicle. (that’s why you find at least one normal cop in every checkpoint even though they are manned by Army)

10. Cops, cannot enter your home or work premises without a court order. You have the fullest right ask for it, if they try to enter and also deny their entrance if you ‘feel’ like it. — incorrect. Where police have reasonable suspicion, they may search premises in the course of their investigations.

11. A traffic cop cannot seize your driving license until he fully states the crime you have committed and the relating penal code violation. If he is unsuccessful in stating them, on can go free — Incorrect - However, policeman will always explain the charge to the offending motorist before his or her license is taken charge of and a temporary driving permit is issued. The temporary driving permit too will mention the offence or violation for which the motorists had been booked.

12. If a ‘traffic cop seizes your license by force and ask you to come to the police station to collect it. Do not go, lodge a complain directly to the Police commission or the ‘Provincial IG?’, you can get the cop sacked for his misconduct and unruly behaviour. — Motorists are required by law to surrender their license when requested by a policeman in uniform. However, the motorists have the right to complain of any alleged misconduct by a policeman to the National Police Commission, the Inspector General of Police or the nearest police station. There is no ‘Provincial IGP’ as stated in number 12 of this article.

13. (For girls), if a cop asks for your Identifications and (if you think he’s doing it on purpose to harass you) you can deny his request. He cannot arrest you! You have the right to request for a Female Police officer. See answer below.

14, (for Girls) if you are asked to be body checked, it’s your right to get it done by a female cop. If they don’t have one in present, deny their action, — No female will be searched by a policeman. Females may request to be searched by a police woman. Any motorist, male or female is required by law to produce documents to the police officer requesting them.
