But three years ago, few of the "female and sisy male" employees of (5 of them) has loged a compliant in the courts saying that their health is at risk when working in my "current office" due to excessive smoking within the office and poor ventilation due to that.
So, we had two choises
1. Fire them off
2. Ban smoking inside the office
(remember, this place is full of lawyers), so we took the option ONE.
The director board fired all 5 of those employees, in-turn the law suite went from a simple compliant to a human rights violation case in high courts !!
But, HELL, we won !!!!!!!!!!!!!!!!!!!!!!
Our point was "If we excersise a ban on smoking within the office premises, it will reduce the emplyee productivity as well as diminish the Moral of smoking employees. Also in the side plate we included the argument of such a case will create a rift between the non-smoking the the smoking crowd which will hinder the business financially as well as sociologically !!"
SO, we won the case and was ordered by the load magistrate to incert a proper ventilations system ( and to be approved by the health ministery) and pay compensation for the fired employees.
NOW.
WE SMOKE INSIDE THE OFFICE !!! and we have TWO CLEAR CLAUSES in our job offering letter that people will SMOKE and you cannot sue us for it
