First it is illegal for a judicial officer to refer a person to mental asylum or even to call for psychiatric report without sufficient evidence for such an action. This is a fundamental right of any person any democratic country where UDHR is accepted as domestic law.
A person could be subjected to medical report if accused of criminal activity eg abuse or rape and provisions are found in CPC.
