The person who threatened the Magistrate over the phone and then led a mob to attack the court was charged for contempt under MR regime in the Court of Appeal.
Unfortunately , he pleaded guilty and was asked to apologize to what he did in Court of Appeal. This was under MR .
So under MR , the standard was set for contempt. One can threaten and attack the courts with a mob but you can apologize and pardoned without a punishment!
If the same standard is applied and MR is also in power, Ven Gnasara should plead guilty for contempt and court is bound to release him if he tenders an apology.
But there are other charges like interference with the witnesses and government officials for which the Magistrate can remand or enlarge on bail. It is a discretion of the magistrate and if not satisfied can appeal to High Court. It is not proper to demonstrate and that shows the indiscipline among the Buddhist monks. I respect them but do not condone the behaviour in this instance after remanding.
