The “Ranjan leaks”
Following is a conversation between Judge Padmini Ranawaka and Ranjan Ramanayake while the case was being heard:
Ranjan-Padmini phone conversation on 14 July 2016 time 9:33 p.m.
Ranjan – I am alone at home. I am talking to you with respect. I am talking to you having read today’s papers. It also went on the TV as well. The country is waiting to find if justice will be meted out in this case. Many thanks. To find that you are one of the Judges presiding over this case is heartening news.
Padmini – OK OK
Ranjan – We are hoping something good will happen in this case.
Padmini – OK OK
Ranjan – I spoke to wish you the best and the God’s blessings.
Another conversation between them played out thus:
Padmini – I need to go to the Court of Appeal. There is presently a vacancy there. However, I am only in the ninth place. The two top persons in the list have been ignored. They were Manilal Waidyathilake and Aruna Ranasinghe. Patali Ranawaka claimed they were rogues. But, they gave it to another rogue. Gamini Amaresinghe has a lot of cases. Ranil Wickremesinghe is much better than him. He had said it was clearly shown in the Duminda Silva case. He had said this when our CJs had berated me, I had not heard it personally.
Ranjan – You are not like Mohan Peiris.
Padmini – I have confidence in you and that is why I spoke to you this morning.
Ranjan – So, tell me what procedure should I adopt?
Padmini – Though I am placed ninth, I had worked for that Department. They overstaffed it and I went below as a result. I should have been in the Appeal Court by now. Both the Town Hall bomb blast case and the Duminda Silva case were heard by me. I will be heading home by 30 November. At least tell them to give it to me, having considered my impending retirement.
Ranjan – Is there a vacancy?
Padmini – Yes, try to at least get it to me with the Appeal Court.
Ranjan – What we must tell the H.E. is that there is a vacancy in the Appeal Court and to fill it up with Padmini Gunathileka.
Padmini – Do not tell him I said so. That Sisira Abrew is cutting me off. Because my name had come into prominence due to the Duminda case he is unhappy with me. He is jealous of me. He is also berating me for no reason. Try to get this done through PM Ranil Wickremesinghe as I am not so confident with the H.E.
Ranjan – Is that so?
Padmini – Ajith P. Perera is known to me. He is from Panadura and try to tell him somehow.
Ranjan – Right, I will try to talk to PM Wickremesinghe, Ajith Perera and the H.E. and get this done for you.
The secret phone conversation between Ramanayaka and CID Director Shani Abeysekara that took place on 10 May 2016 should be considered seriously here.
These audio tapes came to Police possession when a person by the name of Venura Kushantha, the driver of the three-wheeler ABJ 5428, handed a computer hard disk found in his vehicle to the Western Province South District Crimes Division of the Police Department, on 2 January 2020.
After inspecting the audio tapes, the Police had made submissions to the Nugegoda Chief Magistrate’s Court under B 42/2020 before apprehending MP Ranjan Ramanayaka. Afterwards the MP was released on bail and the probe continued.
The CID informed Court that through the audio tapes they had discovered the MP had spoken to several Judges and Magistrates concerning cases pending in Courts and had influenced the outcomes of certain cases. The CID had filed charges that Ramanayaka had intentionally intervened in cases being presided over by Judges Padmini Ranawaka, Gihan Pilapitiya and Magistrate Dhammika Hemapala and had pressured them. The actions of the MP had flouted Article 111 (2) of the Constitution.
MP’s intrusion into the Bharatha Laksman case by phoning Judge Ranawaka and then CID officer Shani Abeysekara is a serious offence. Court was informed that there were 22 conversations between Ramanayaka and Abeysekara between 14 July 2016 and 11 September 2019.
Following are some of them:
Ranjan-Shani phone conversation on 25 July 2016, Time – 12:12 p.m.
Shani – Sir, it is urgent. Can I speak to you?
Ranjan – Yes you can.
Shani – Sir I plead to you, do not talk about that case with anyone or else it will blow up right in our faces.
Ranjan – Is that true?
Shani – Yes, I beg you do not talk openly about it with anyone.
Ranjan – Yes.
Shani – The case is now at a pivotal juncture.
Ranjan – Yes.
Shani – Sir, even what you had spoken about it could go against us. However, we will try to balance it somehow.
Ranjan – Right, right I will not tell anyone. Today I will be meeting H.E. at 5 p.m.
Shani – Sir, I again beg you do not speak to Madam Ranawaka about the case. If so, it will create a lot of problems for us all.
Ranjan – Is there anyone there with you?
Shani – No.
Ranjan – I spoke to Madam and told her that she had spoken to me in rather crestfallen manner. I only spoke to her and said the country is waiting to hear the verdict of the case on the 9th. The entire country is waiting to hear the verdict on this murder which took place in broad daylight. After that, she said that she would ring me back as someone had come to her and hung-up the phone.
Shani – Is that all?
Ranjan – Yes I only reminded her that the country was waiting to hear the verdict of the trial.
Shani – Would you talk to the Madam again?
Ranjan – Yes.
Shani – They had all joined the other group. They will agree with the other one.
Ranjan – Is that so?
Shani – What Hirunika did those days was berating us.
Ranjan – I feel Hirunika should worship you for having sent this guy in.
Shani – Whenever the case was being heard she blasted us that the CID was not doing its job. Now, Sir, do you at least agree that the CID took the case to the High Court.
Ranjan – So isn’t this clear to any donkey that the accused had been cornered by the CID.
Shani – Sir, try to go through the visuals and see as to whom Hirunika had blasted. She once told me I want to speak to Mr. Abeysekara. I just told her I have no right to talk to you. You better speak to honourable AG. What would have happened if they took a picture of me making a deal?
Ranjan – Haven’t you both played a game?
Shani – I have no deals because I’m afraid of Ranjan.
Ranjan – Yes, yes
Shani – I was told to go to Singapore to record a statement from Duminda. DIG Jayantha Kulathileka told me you go and record this. I told him I cannot go as I would be in trouble. Now he says he cannot remember anything. If I had gone and recorded his statement I would have been seen as a fool. I told him to send anyone of his choice. Ranjan went alone.
Ranjan – Now Shani, you and I are pals. Has there been any misfire on my part?
Shani – Sir, talking to Madam Ranawaka is a folly.
Ranjan – Why, she has been a pal of mine.
Shani – Those connections are now over. If it is known that you had spoken to her it could pose serious issues to all of us.
Ranjan – No.
Shani – If the three of them agree and write a verdict in unison then we are finished.
Ranjan – No it won’t be the case. I only got through to her private phone from my private phone. Other than us, only you are aware of it.
Shani – Right, Sir I have come to know that you had spoken to her.

Ranjan – May God Bless. I am so cut up that this man had not been remanded even for a minute. He had fired the shot on the road.
Shani – If this guy had been remanded in those days, then we would have been in dire straits.
Ranjan – Yes that is true. Has the case turned in favour of us?
Shani – The notes entered by me, I will hand them to you after the case.

Ranjan – Shani the case is this. Now your target is sending Duminda. My target is also the same. Bharatha’s wife’s target is the same and so is Hirunika’s. So, is there any reason for us to quibble over it?
