    As salamu alaikum,

    After the 911 incident, Sheikh Yusuf Al-Qaradawi made a statement in regards to "Islam and terrorism"
    (http://www.islamonline.net/English/News/2001- 09/12/article25.shtml). I felt that what he had to say was and still is very important, especially in light of what has been happening lately, hopefully we will all be benefited from it.


    Sheikh Yusuf Al-Qaradawi Condemns Attacks Against Civilians: Forbidden in Islam

    DOHA, Qatar, Sept 13 (IslamOnline & News Agencies) - Renowned Muslim scholar Sheikh Yusuf al-Qaradawi denounced the attacks against civilians in the U.S. Tuesday and encouraged Muslims to donate blood to the victims of the attack.

    In response to the bloody attack against civilians in the U.S., Sheikh Yusuf issued a statement Wednesday saying that:

    "Our hearts bleed for the attacks that has targeted the World Trade Center [WTC], as well as other institutions in the United States despite our strong oppositions to the American biased policy towards
    Israel on the military, political and economic fronts.

    "Islam, the religion of tolerance, holds the human soul in high esteem, and considers the attack against innocent human beings a grave sin, this is backed by the Qur'anic verse which reads:

    Who so ever kills a human being for other than manslaughter or corruption in the earth, it shall be as if he has killed all mankind, and who so ever saves the life of one, it shall be as if he had saved the life of all mankind," (Al-Ma'dah:32).

    "The Prophet, peace and blessings be upon him, is reported to have said, 'A believer remains within the scope of his religion as long as he doesn't kill another person illegally'," the prominent scholar
    said.

    He added that haphazard killing where the rough is taken with the smooth and where innocents are killed along with wrongdoers is totally forbidden in Islam. No one, as far as Islam is concerned, is
    held responsible for another's actions. Upon seeing a woman killed in the battlefield, the Prophet, peace and blessings be upon him, denied the act and said: "That woman shouldn't have been killed anyway!"

    Even in times of war, Muslims are not allowed to kill anybody save the one who is indulged in face-to-face confrontation with them. They are not allowed to kill women, old persons, children, or even a monk in his religious seclusion.

    Qaradawi then asserted that is why killing hundreds of helpless civilians who have nothing to do with the decision-making process and are striving hard to earn their daily bread, such as the victims of the latest explosions in America, is a heinous crime in Islam. The Prophet, peace and blessings be upon him, is reported to have stated that a woman was qualified to enter Hell because of the cat she locked up to death.

    "If such is the ruling applied in protecting animals, no doubt, aggression against human beings, a fortiori, deserves greater protection, for human beings are honored by Allah Almighty and are His vicegerents on earth," he added.

    Al Qaradawi said, "we Arab Muslims are the most affected by the grave consequences of hostile attack on man and life. We share the suffering experienced by innocent Palestinians at the hands of the tyrannical Jewish entity who raze the Palestinian homes to the ground, set fire to their tilth, kill them cold-bloodedly, and leave innocent orphans wailing behind.

    "With this in mind, the daily life in Palestine has become a permanent memorial gathering. When Palestinians face such unjust aggression, they tend to stem bloodletting and destruction and not
    to claim the lives of innocent civilians."

    "I categorically go against a committed Muslim's embarking on such attacks. Islam never allows a Muslim to kill the innocent and the helpless.

    "If such attacks were carried out by a Muslim - as some biased groups claim - then we, in the name of our religion, deny the act and incriminate the perpetrator. We do confirm that the aggressor deserves the deterrent punishment irrespective of his religion, race or gender," he added.

    "What we warn against, even if becomes a reality, is to hold a whole nation accountable for a crime carried out by a limited number of people or to characterize a certain religion as a faith giving support to violence and terrorism," Qaradawi said.

    Qaradawi clarified that when the well-known Oklahoma incident was carried out by a Christian American, who was driven by a personal interests, Christianity, America or even the Christian world, were not accused of the attack because a Christian masterminded it.

    "I have been asked several questions on TV programs and on public lectures about the martyr operations outside the Palestinian territories, and I always answer that I do agree with those who do not allow such martyr operations to be carried out outside the Palestinian territories.

    "Instead we should concentrate on facing the occupying enemy directly. It is not permissible, as far as Islam is concerned, to shift confrontation outside the Palestinian territories. This is backed by the Qur'anic verse that reads: "Fight in the way of Allah against those who fight against you, but begin not hostilities. Lo! Allah loves not, aggressors," the renowned Muslim scholar concluded.

    What Does Islam Say about Terrorism?

    In the Name of Allah, Most Gracious, Most Merciful.

    All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

    Asalam-o-Alikum;

    In the first place, we would like to stress that the study of world history would show that Islam and terrorism are extreme opposites. There is no meeting point between Islam and terrorism as practiced by terrorist groups in different parts of the world. Terrorism involves the indiscriminate use of force to achieve certain objectives. Whereas, the basis of national and international relations in Islam is peace and not war as falsely claimed by some people.

    In Islam, the use of force is allowed only in special situations, particularly when the Muslim community is threatened by hostile forces. This is natural and logical for any other community indeed. Then again, the use of force in a campaign of Jihad is determined by the leader of the Muslim community in a very orderly way.

    For a detailed discussion on the Islam’s stance on terrorism, we would like to cite for you the following:

    “One of the distinctive characteristics of the times we live in is the overwhelming presence of violence in our societies. Whether it is a bomb going off in a market place, or the hijacking of an aircraft where innocent people are held at ransom to achieve political ends, we live in an age, where the manipulation and loss of innocent lives has become commonplace.

    Such is the all-pervasive nature of indiscriminate violence, that “terrorism” is considered as one of the prime threats to peace and security in our societies.

    The word “terrorism” came into wide usage only a few decades ago. One of the unfortunate results of this new terminology is that it limits the definition of terrorism to that perpetrated by small groups or individuals. Terrorism, in fact, spans the entire world, and manifests itself in various forms. Its perpetrators do not fit any stereotype. Those who hold human lives cheap, and have the power to expend human lives, appear at different levels in our societies.

    The frustrated employee who kills his colleagues in cold-blood is a terrorist who provokes our anger and revulsion. Ironically however, the politician who uses age-old ethnic animosities between peoples to consolidate his position, the head of state who orders “carpet bombing” of entire cities, the exalted councils that choke millions of civilians to death by wielding the insidious weapon of sanctions, are rarely punished for their crimes against humanity.

    It is this narrow definition of terrorism that implicates only individuals and groups, that has caused Muslims to be associated with acts of destruction and terror, and as a result, to become victims of hate violence and terror themselves. Sometimes the religion of Islam is held responsible for the acts of a handful of Muslims, and often for the acts of non-Muslims!

    Could it be possible that Islam, whose light ended the Dark Ages in Europe, now propound the advent of an age of terror? Could a faith that has over 1.2 billion followers the world over, and over 7 millions in America, actually advocate the killing and maiming of innocent people? Could Islam, whose name itself stands for “peace” and “submission to God”, encourage its adherents to work for death and destruction?

    For too long, have we relied on popular images in the media and in Hollywood films, for answers to these pertinent questions. It is now time to look at the sources of Islam, and its history to determine whether Islam does indeed advocate violence.

    The Sanctity of Human Life


    The Glorious Qur’an says: “…take not life, which God hath made sacred, except by way of justice and law: thus doth He command you, that ye may learn wisdom.” (Al-An`am: 151)

    Islam considers all life forms as sacred. However, the sanctity of human life is accorded a special place. The first and the foremost basic right of a human being is the right to live. Allah says in the Qur’an says

    : “… if any one slew a person - unless it be for murder or for spreading mischief in the land - it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people.”

    Such is the value of a single human life, that the Qur’an equates the taking of even one human life unjustly, with killing all of humanity. Thus, the Qur’an prohibits homicide in clear terms. The taking of a criminal’s life by the state in order to administer justice is required to uphold the rule of law, and the peace and security of the society. Only a proper and competent court can decide whether an individual has forfeited his right to life by disregarding the right to life and peace of other human beings.

    The Ethics of War
    (Al-Ma’idah: 32)

    Even in a state of war, Islam enjoins that one deals with the enemy nobly in the battlefield. Islam has drawn a clear line of distinction between the combatants and the non-combatants of the enemy country. As far as the non-combatant population is concerned such as women, children, the old and the infirm, etc., the instructions of the Prophet are as follows: "Do not kill any old person, any child or any woman.” (Reported by Abu Dawud) "Do not kill the monks in monasteries" (Musnad Ahmad ibn Hanbal)

    During a war, the Prophet (peace and blessings be upon him) saw the corpse of a woman lying on the ground and observed: "She was not fighting. How then she came to be killed?" Thus non-combatants are guaranteed security of life even if their state is at war with an Islamic state.

    Jihad

    While Islam in general is misunderstood in the western world, perhaps no other Islamic term evokes such strong reactions as the word ‘Jihad’. The term ‘Jihad’ has been much abused, to conjure up bizarre images of violent Muslims, forcing people to submit at the point of the sword. This myth was perpetuated throughout the centuries of mistrust during and after the Crusades. Unfortunately, it survives to this day.

    The word Jihad comes from the root word iahada, which means to struggle. So Jihad is literally an act of struggling. Jihad primarily refers to the inner struggle of being a person of virtue and submission to God in all aspects of life.

    Secondarily, Jihad refers to struggle against injustice. Islam, like many other religions, allows for armed self-defense, or retribution against tyranny, exploitation, and oppression. The Glorious Qur’an says: “And why should ye not fight in the cause of God and of those who, being weak, are ill-treated (and oppressed)? Men, women, and children, whose cry is: ‘Our Lord! Rescue us from this town, whose people are oppressors; and raise for us from thee one who will protect; and raise for us from thee one who will help!" (Aal-`Imran: 75)

    Thus Islam enjoins upon its believers to strive their utmost in purifying themselves, as well as in establishing peace and justice in the society. A Muslim can never be at rest when he sees injustice and oppression around him. As Martin Luther King Jr. said: “We will have to repent in this generation not merely for the hateful words and actions of the bad people but for the appalling silence of the good people.”

    Islam enjoins upon all Muslims to work actively to maintain the balance in which God created everything
    . However, regardless of how legitimate the cause may be, the Glorious Qur’an never condones the killing of innocent people. Terrorizing the civilian population can never be termed as Jihad, and can never be reconciled with the teachings of Islam.

    History of Tolerance

    Even Western scholars have repudiated the myth of Muslims coercing others to convert. The great historian De Lacy O'Leary wrote: "History makes it clear, however, that the legend of fanatical Muslims, sweeping through the world and forcing Islam at the point of sword upon conquered races is one of the most fantastically absurd myths that historians have ever repeated.” (Islam At Crossroads, London, 1923, page 8)

    Muslims ruled Spain for roughly 800 years. During this time, and up until they were finally forced out, the non-Muslims there were alive and flourishing. Additionally, Christian and Jewish minorities have survived in the Muslim lands of the Middle East for centuries. Countries such as Egypt, Morocco, Palestine, Lebanon, Syria, and Jordan all have significant Christian and/or Jewish populations.

    This is not surprising to a Muslim, for his faith prohibits him from forcing others to see his point of view. The Glorious Qur’an says: Let there be no compulsion in religion: Truth stands out clear from Error: whoever rejects evil and believes in God hath grasped the most trustworthy hand-hold, that never breaks. And God heareth and knoweth all things.” (Al-Baqarah: 256) :cool:

    Islam: The Great Unifier


    Far from being a militant dogma, Islam is a way of life that transcends race and ethnicity. The Qur’an repeatedly reminds us of our common origin: “O mankind! We created you from a single (pair) of a male and a female, and made you into nations and tribes, that ye may know each other (not that ye may despise (each other). Verily the most honored of you in the sight of God is (he who is) the most righteous of you. And God has full knowledge and is well acquainted (with all things).”:)

    Thus, it is the universality of its teachings that makes Islam the fastest growing religion in the world. In a world full of conflicts and deep schisms between human beings, a world that is threatened with terrorism, perpetrated by individuals and states, Islam is a beacon of light that offers hope for the future.”
    (Al-Hujrat: 13)



    n the light of the above, it becomes crystal clear that Islam, the true religion of Allah, doesn’t permit aggression, violence, injustice, or oppression. At the same time, it calls to morality, justice, tolerance, and peace.

    The Prophet Prohibited the Killing of Women and Children
    There are so much hadith where the Prophet condemned the killing of innocent women and children during time of war that it is impossible to deny them.
    Saheeh Bukhari
    Volume 004, Book 052, Hadith Number 257.
    Narrated By 'Abdullah : During some of the Ghazawat of the Prophet a woman was found killed. Allah's Apostle disapproved the killing of women and children.

    Volume 004, Book 052, Hadith Number 258.
    Narrated By Ibn 'Umar : During some of the Ghazawat of Allah's Apostle a woman was found killed, so Allah's Apostle forbade the killing of women and children.

    Book 019, Hadith Number 4319.
    Chapter : Prohibition of killing women and children in war.
    It is narrated on the authority of 'Abdullah that a woman was found killed in one of the battles fought by the Messenger of Allah (may peace be upon him). He disapproved of the killing of women and children.

    Chapter : Prohibition of killing women and children in war.
    It is narrated by Ibn 'Umar that a woman was found killed in one of these battles; so the Messenger of Allah (may peace be upon him) forbade the killing of women and children.

Khalid ibn al-Walid was in charge of the van; so he sent a man and said: Tell Khalid not to kill a woman or a hired servant.

    Yahya related to me from Malik from Ibn Shihab that a son of Kab ibn Malik (Malik believed that ibn Shihab said it was Abd ar-Rahman ibn Kab) said, "The Messenger of Allah, may Allah bless him and grant him peace, forbade those who fought ibn Abi Huqayq (a treacherous jew from Madina) to kill women and children. He said that one of the men fighting had said, 'The wife of ibn Abi Huqayq began screaming and I repeatedly raised my sword against her. Then I would remember the prohibition of the Messenger of Allah, may Allah bless him and grant him peace, so I would stop. Had it not been for that, we would have been rid of her.'"

    Book 021, Hadith Number 009.
    Section : Prohibition against Killing Women and Children in Military Expeditions.

    Yahya related to me from Malik from Nafi from Ibn Umar that the Messenger of Allah, may Allah bless him and grant him peace, saw the corpse of a woman who had been slain in one of the raids, and he disapproved of it and forbade the killing of women and children.

    Section : Prohibition against Killing Women and Children in Military Expeditions.

    Yahya related to me from Malik from Yahya ibn Said that Abu Bakr as-Siddiq was sending armies to ash-Sham. He went for a walk with Yazid ibn Abi Sufyan who was the commander of one of the battalions. It is claimed that Yazid said to Abu Bakr, "Will you ride or shall I get down?" Abu Bakrsaid, "I will not ride and you will not get down. I intend these steps of mine to be in the way of Allah."
    Then Abu Bakr advised Yazid, "You will find a people who claim to have totally given themselves to Allah. Leave them to what they claim to have given themselves. You will find a people who have shaved the middle of their heads, strike what they have shaved with the sword.
    "I advise you ten things| Do not kill women or children or an aged, infirm person. Do not cut down fruit-bearing trees. Do not destroy an inhabited place. Do not slaughter sheep or camels except for food. Do not burn bees and do not scatter them. Do not steal from the booty, and do not be cowardly."
    The Prophet made some exceptions to the Killing of Women and Children
    Saheeh Bukhari

    Narated By As-Sab bin Jaththama : The Prophet passed by me at a place called Al-Abwa or Waddan, and was asked whether it was permissible to attack the pagan warriors at night with the probability of exposing their women and children to danger. The Prophet replied, "They (i.e. women and children) are from them (i.e. pagans)." I also heard the Prophet saying, "The institution of Hima is invalid except for Allah and His Apostle."
    Saheeh Muslim
    Book 019, Hadith Number 4321.

    Chapter : Permissibility of killing women and children in the night raids, provided it is not deliberate.


    It is reported on the authority of Sa'b b. Jaththama that the Prophet of Allah (may peace be upon him), when asked about the women and children of the polytheists being killed during the night raid, said: They are from them.
    There are many possible meanings for these Hadith. I was kind of surprised when I read it at first. But we don’t know the EXACT situation or what the Prophet truly meant. Maybe, maybe THOSE particular women and children were planning to fight against the Muslims with the enemy.
    Maybe the Muslim army just could not have blown this chance to attack the enemy that they still had to attack them no matter at what cost in order to stop the risk of more blood shed (do a little bad for the greater good).
    The very fact that the companions of the Prophet asked the Prophet's permission shows that the Prophet used to be strict regarding his prohibition on the killing of women and children. However, when a situation arises and there is no choice, things could get ugly. The Prophet even forbade the cutting down of palm trees in war, however during the siege of Banu Nadir the Prophet had to make an exception. So exceptions do arise unfortunately.
    Imam Ibn Hajar Al Asaqalani says in Fath Al- Baari that the point is not to target the women and children intentionally but if there is absolutely no other way to kill the enemy than by injuring the women and children because they are mixed with the men then there is no other choice.     Another possibility is that the hadith has been abrogated and that even if women and children accompany the enemy during war then they still should not be killed. (See http://hadith.al-islam.com/Display/Display.asp?Doc=0&Rec=4747 for the evidence)
    Imam Nawawi says in his tafseer of Saheeh Muslim that women and children are only killed only if they cannot be distinguished. But because it was so dark and they could not be distinguished, the Muslims had not choice. (Source: http://hadith.al-islam.com/Display/Display.asp?Doc=1&Rec=4215)

    In islam it is strict forbidden to kill women , children and/or innocents. The only way that they can be killed is as an unintentional consequence of fighting against the enemy combatants.

    Asalamu alaykum Shaykh, I have read the fatwa section on Jihad but I am looking for clarification of a specific Hadith found in Sahih Bukhari which is propagating as some as a refutation to what you have mentioned: Narrated as-Saíb bin Jaththama: The Prophet passed by me at a place called al-Abwa or Waddan, and was asked whether it was permissible to attack the pagan warriors at night with the probability of exposing their women and children to danger. The Prophet replied, "They are from them." Could you please clarify the context of this Hadith and whether it contradicts the general ruling of prohibition of targeting civilians which you mentioned elsewhere? JazakAllah khair.

    Al-Salâm `Alaykum wa Rahmah Allah wa Barakâtuh.


    Those who are not generally engaged in fighting – like women, children, the elderly, the handicapped, and others who do not participate in the fighting – are not to be killed. The Prophet (peace be upon him) prohibited this. His prohibition of the killing of women and children is clearly related by Ibn `Umar in Sahîh al-Bukhârî (3015) and Sahîh Muslim (1744).


    The only exception to this is where such people participate directly in the fighting or are so intermixed with the fighters that it is impossible to separate them from those who are fighting. This exception is indicated by the hadîth of al-Sa`b b. Jathâmah. The Prophet (peace be upon him) was asked about the women and children of the polytheists who were among them and who would be injured if the enemy was attacked. He said: “They are of them.” [Sahîh al-Bukhârî (3021) and Sahîh Muslim (1475)]


    In short, non-Muslims living in Muslim lands, those who are under covenant, and those with whom we have peace cannot be attacked. As for those who are at war with us, the combatants may be fought and killed. Those who are not combatants cannot be killed or targeted for killing. The only way that they can be killed is as an unintentional consequence of fighting against the enemy combatants.


    Indeed, the hadîth in question actually shows us that the general rule is not to kill non-combatants, even when they are present on the battlefield. The only exception is when the non-combatants are so mixed in with the fighters that it is impossible to fight against the combatants without the possibility of some non-combatants inadvertently being killed. This is only out of dire necessity.


    Ibn Hajar writes in his commentary on this hadîth in Fath al-Bârî (6/146):


    His statement “They are of them” means that they are construed as such under those circumstances. It does not mean that it is permissible to deliberately target them.


    It is a matter of agreement among scholars that a person’s unbelief is not reason for that person to be killed. There is considerable evidence for this. Aside from the Prophet’s prohibition of killing non-combatants, we have where Allah says: “Let there be no compulsion in religion.” [Sûrah al-Baqarah: 256]



    - Islam forbids the killing of innocent lives (women and children)


    Noble Verse 5:32

    "if any one slew a person - unless it be for murder or for spreading mischief in the land - it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people..."

    In this Noble Verse we clearly see that Allah Almighty honors all the innocent souls that He created. Killing any innocent soul is so hated by Allah Almighty that He considers it as a crime against all of Mankind.     Noble Verses 2:190-191

    "Fight in the cause of Allah those who fight you, but do not transgress limits; for Allah loveth not transgressors.

    Despite all the hard conditions that the Muslims faced, Allah Almighty still ordered them "...not transgress limits; for Allah loveth not transgressors."



    - The prophet prohibited the killing of women,children and innocents



    Ibn `Abbas says: The Messenger of Allah, when dispatching his troops, would tell them, " ..Do not behave treacherously, nor misappropriate war-booty, nor mutilate [those whom you kill], nor kill children, nor the people in cloisters." [Narrated by Ahmad, Tirmidhi (who graded it hasan sahih ]).


    Another contains, "…Do not kill a woman, nor a child, nor an old, aged man’ [Narrated by Baghawi, through his isnad [Sharh al-Sunnah, 11/11]. He said, "This is an authentic hadith, narrated by Muslim.]

    It is narrated by Ibn 'Umar that a woman was found killed in one of these battles; so the Messenger of Allah (may peace be upon him) forbade the killing of women and children. [Sahih Muslim, Book 019, Number 4320]
    You are neither hard-hearted nor of fierce character, nor one who shouts in the markets. You do not return evil for evil, but excuse and forgive." [Sahih Bukhari, Volume 6, Book 60, Number 362]
    Narrated Anas ibn Malik: The Prophet (peace_be_upon_him) said: Go in Allah's name, trusting in Allah, and adhering to the religion of Allah's Apostle. Do not kill a decrepit old man, o a young infant, or a child, or a woman; do not be dishonest about booty, but collect your spoils, do right and act well, for Allah loves those who do well. (Sunan Abu Dawud , Book 14, Number 2608)

    Another contains, "…Do not kill a woman, nor a child, nor an old, aged man…" [Narrated by Baghawi, through his isnad [Sharh al-Sunnah, 11/11]]
    Another contains, "Do not kill a child, nor a woman, nor an old man, nor obliterate a stream, nor cut a tree…" [ Narrated by Bayhaqi,vide I`la al-Sunan, 12/31 ]

    'Avoid the seven ruinous [sins] … associating partners with Allah, sorcery,unrightfully taking life which Allah has prohibited, consuming riba, consuming the property of an orphan, fleeing on the day of marching [in battle], and accusing a chaste, oblivious believing woman of adultery (Narrated by Bukhari, Muslim, Nasa'i, Abu Dawud)

    Ibn `Umar said, "Allah curses the one who does this. Verily, the Messenger of Allah cursed the one who takes something with a soul as a target." [Narrated by Muslim via Ibn `Umar as quoted, and by Nasa'i via 2 routes (Ibn `Umar and Ibn `Abbas)]


    Another version says, "The Messenger of Allah forbade taking something with a soul as a target."[Narrated by Tirmidhi (who graded it hasan sahih).and Ahmad, via Ibn `Abbas. Both of them included mention of Ibn `Abbas witnessing an incident involving a pigeon, similar to that witnessed by Ibn `Umar as in the preceding narration.]


    Allah curses the one who takes something with a soul as a target (Narrated by Ahmad, through a sound, contiguous chain of transmitters (Hushaym-Abu Bishr-Sa`id ibn Jubayr-Ibn `Umar)
