exactlyIt is like this.Even if the payhere terms had a clause saying they are not liable for a data breach court has the ability to determine whether the clause was an "unfair"/"unlawful" term and strike it out of the contract making the company liable for the data breach.
Also seemingly they knew about the data breach long before they made a statement about it to the public putting the users in further danger. This is unacceptable as it shows that payhere has not done enough to mitigate the loss to its users.
Furthermore, payhere to date has not setup an internal system for users to check if their data has been stolen and instead is directing users to haveIbeenpwned which is a 3rd party site.
Personally I think that they can be sued for millions.
