    It is like this.Even if the payhere terms had a clause saying they are not liable for a data breach court has the ability to determine whether the clause was an "unfair"/"unlawful" term and strike it out of the contract making the company liable for the data breach.

    Also seemingly they knew about the data breach long before they made a statement about it to the public putting the users in further danger. This is unacceptable as it shows that payhere has not done enough to mitigate the loss to its users.

    Furthermore, payhere to date has not setup an internal system for users to check if their data has been stolen and instead is directing users to haveIbeenpwned which is a 3rd party site.

    Personally I think that they can be sued for millions.

    Find a lawyer to sue for 100mil and agree to give him the half or forward your documents to civil societies that offer free lawyers.
    It’s a lengthy process, and probably not many lawyers might consider taking it, as Justice in Sri Lanka specially towards anything or financial can take years and decades.

    Yea true but worth fighting cause the case is fully on users side. Basha will surely settle out of court. So easy money.

    Meet a lawyer and take advice on this. You will need a good one. if possible get a few more and file a case rather than filing alone.
    You should sue this bugger because it's not something you should take for granted.

    Agreements can be ruled unlawful. They can have whatever they want in their agreements but if taken to the court they have to prove that their terms were fair and lawful.

    bump if this kind of shit happened in Europe they have to pay a huge ass of money as fine for the court and then have to pay to each individual.

    unfortunately sri lankan court and legal system is far way behind so these kind of stuff drag for decades
