Solve If You Can

4 criminals are caught and are to be punished. The Judge allows them to be freed if they can solve a puzzle. If they do not, they will be hung. They agreed.

The 4 criminals are lined up on some steps (shown in picture). They are all facing in the same direction. A wall seperates the fourth man from the other three.

So to summarise :-
Man 1 can see men 2 and 3.
Man 2 can see man 3.
Man 3 can see none of the others.
Man 4 can see none of the others.

The criminals are wearing hats. They are told that there are two white hats and two black hats. The men initally don't know what colour hat they are wearing. They are told to shout out the colour of the hat that they are wearing as soon as they know for certain what colour it is.

They are not allowed to turn round or move.
They are not allowed to talk to each other.
They are not allowed to take their hats off.

Who is the first person to shout out and why?

PS: There is no trick to the question, just logical deduction

situation 1-2,3 wear same colour
1st one can see 2,3.Since there is 2 black and 2 white if 2,3 wear the same colour, 1st one will shout the other colour.So he wins.
But if he sees both colours he will not shout.

situation 2-2,3 wear different colour
Thinking that 2nd one is aware of what 1st one can think and shout,2nd one will surely know that 1st one didn't shout coz he and 3 wear different colour hats.So he will shout the oppsite colour of the 3rd one.In pictures case he sees black on 3 and will shout"white".
SO there are 2 answers for 2 situations.Either no 1 or no 2.
P.S-I dont think this logic can be beaten,I thought of it again

No the 2nd answer is correct you fool. See 1st one cant shout a colour coz he cant actually tell which is on his head.So the 2nd one immediately guesses it and shoutes "white" coz he sees yeah thats the thing..

there are two situations..but if its the one on th epicture..then its tough the 3 is wearing black.That is my 2nd answer.
