Can't you will get banned from the network. When your connecting to xbox live it checks the firmware to see if it is modified or not then block the connection adding console's serial number to the banned list.

Yes you can play online without an issue in SL with a non-modified xbox. I'm also playing COD MW 3 and Medal of Honor online (multiplayer) using a 512kbps Dialog Wi-Max no lag at all.

Actually you can. There may be other mods (RGH,XK3Y,etc) which you can do this on but since my experience is with LT 3.0 mod I'll share what I know.
- Your console must be flashed with LT 3.0 mod and must be running the latest dashboard version.
- The game ISO you used to burn the disk should be stealth patched and verified. You can do this easily using a software called ABGX.
- You must burn the game using a DVD burner flashed with Burnermax firmware. Burnermax is a special DVD drive firmware that allows you write till the edge of DVD disk. You need this because new XBOX360 ISO image format (XGD3) has 8.5GB of data which require writing till the very edge of a dual layer disk. Only certain LiteOn and ASUS burners are compatible with Burnermax firmware.
- Your DVD disk must verify 100% after burn. It is recommended that you use Verbatim DL disks for maximum reliability.
If you follow the best practices above, you will not get banned playing online on XBOX Live when using a modded console.
But why take the risk/or hassle because if you get banned you will never be able to connect live again unless you buy a new console.
There's always a risk, firmware is getting updates by time to time and there maybe server-side security patches which applies to prevent the access of modified consoles. Because Microsoft is fully aware of this matter and don't think that they are just sitting and flirting around.
So far, whatever Microsoft has thrown in terms of anti piracy has been overcome by hackers. Their latest attempt was using AP 2.6 protection with XGD3 ISO format which was beaten with LT3.0 mod (and numerous other glitches). Of course MS is aware of the problem and release security updates from time to time. But mod developers too update their mods to match whatever Microsoft comes up with. Almost every XBOX360 game that has been released in the last 6-7 years can be played on a modified console and that's saying something.
Of course, if you can afford genuine games that is always the recommended way to go. But what I was saying was that I don't see myself buying games at Rs8000 per title so I choose to pirate. I'm not proud of it or anything, but I don't see a risk in it nor consider it a hassle. You just have read the news and not update system software until the modder clears it to be compatible with the mod.
