    කම්කරු නීතිය ගැන දැන්න කෙනෙක් ඉන්නවද

    කම්කරු නීතිය ගැන දැන්න කෙනෙක් ඉන්නවද. එක පාරටම බේසික් එකෙන් 50% අඩු කරන්න පුලුවන්ද. අනාත වෙලා ඉන්නෙ. covid 19 නිසා මාස 3ක් යනකන් salary ගෙවන්නෙ 50%ලු. අපෙන් කැමතිද කියලවත් ඇහුවෙ නෑ :no::no::no:

    and are they paying the balance 50% after 3 months ?
    They can request to split and pay during financially impacted times but it is with a plan to pay the balance.
    They cannot just cut the salary in half unless there's a written agreement with the employee or there is a clause for performance based salary payments.

    They are not informed any details mcn. The only thing we have informed is the 50% deduction of salary. That also informed over the phone. and they are trying to issue cheque payment instead of bank deposit. which means they not only deduct salary but also not paying epf/etf.

    Cheque pay does not mean no EPF/ETF.
    They can't just cut the pay like that unless there's a clause for it in the letter of appointment.
    Whats the company ? no structured company will do it like that.


    What usually happens is that part payment is requested from higher salaried employees (usually management) with a plan to pay the balance due on a later date.
    Low salaried employees will be paid in full, usually the non executive category.
    Everyone in between can get a percentage of the salary but again, with a payment plan and a request for the employee to agree to it.
    If the employee doesn't agree, the company will have to pay full salary or pay compensation (usually 3 months salary upfront) and fire the the employee.

    But they have already processed payroll man. Thats why im looking for any legal advice

    Thats the thing mcn. They not informed partial payment and pay balance later. As per them due to covid 19 impact management has decided to cut down salary from top to bottom and salary not deposit to bank. I want to know about what is the legal side of this matter.
