    Temple Elephant Not Living the Holy Life

    In Colombo, Sri Lanka, a 6 year old elephant, Ganga, is chained in front of a temple. This is the reality of her lonely life. She displays *stereotypic behaviour. The chains are tight on one front leg and one at the back. When she lays down he has to lay down in her own urine and faeces. It is thought Ganga may be a wild caught elephant.

    This is at a Buddhist Temple. When we think of Buddhists, we usually think of kindness, patience, care and compassion. Yet often, cultural norms, ignorance and not paying attention means the animals in the 'care' of a temple are basically abused as we understand abuse in the West.



    Her life most probably started in the wild, she was captured and the temple may well be lying about her source. They say that she was born to a captive mother, who subsequently died. Is there proof of her origins? This news article details the concerns of her wild origins

    THE LAW IN SRI LANKA

    The FAUNA AND FLORA PROTECTION (AMENDMENT) ACT, No. 22 OF 2009 is explicit in the illegality of capturing a wild elephant.

    Section 12: Save as is hereinafter provided, no person shall in any area out side a National Reserve or Sanctuary hunt, shoot, kill, injure or take any elephant,

    Further it also outlines that any female elephant who is pregnant and gives birth or has a still birth, or the calf dies following the birth shall notify the officials. It is highly unlikely that Ganga's mother was as stated a captive elephant who subsequently died. if she was - where is the record of Ganga's birth and her mother's subsequent death?

    Section 23: “
    (9) In the event of a pregnancy of a registered she elephant, the owner or the person having the custody of such she elephant shall inform the Director-General of such pregnancy together with details of the sire. (and)

    (10) It shall be the duty of the owner or the person having custody of a registered she elephant to inform the Director-General or any authorized officer of the fact of any birth, miscarriage or still birth of elephants within seven days of the date of the occurrence of any of the said events.

    (11) Where any registered elephant dies, the owner or the person having custody of such elephant shall report such death to the Director-General, before the remains are destroyed. (and)

    (12) Any elephant which has not been registered under this section shall be presumed to be taken or removed from the wild without lawful authority or approval and such elephants shall be deemed to be public property. The provisions of the Offences Against Public Property Act, No. 12 of 1982 shall accordingly apply in respect of such elephants.”.
