in a situation like this , obviously that officer will be punished by the law of military... in the 2nd scenario probably he will be punished by the civil law

its not CIVIL law and its treated under criminal law and the punishment is death or lifetime imprisonment.. treason or propagating is a action which require punishment to safeguard the interest of a country...

apostasy or leaving from its original faith isn't a crime, but propagating against its original faith is a crime.. this will receive the capital punishment in islam.
