If you are not bothered about getting a service letter, just leave. They can't do anything about it. They can't hold your EPF/ETF or refuse to pay your salary. Its illegal.
You are entitled to set off ALL your annual and casual leave against your notice period. They can't prevent you from that. Its illegal.
They can't change the employment contract without your singature. That's also illegal.
They don't need to "accept" your resignation letter. There's nothing in the shop and office act about "accepting" your resignation.
If they take you to courts, they need to prove that the violation of the employment contract on your part resulted in direct financial loss to them. If they can't prove that, no judge will entertain the case.
The only thing they can withhold is your service letter. They are not legally bound to issue you one.
    Thank you

    Exactly no update was given
Then go to HR and say if something have changed , you have to inform us or should update contracts . If not im bond with current contract i have . If you dont cooperate with what you told when you recruiting me im going to labour department and file a case .

Always try to video your conversation with HR in these kind of times so you have proper evidence . Even you can say im recording this , then you can see how there faces are changed but do it secretly much as possible

I want to resign from my current company before the notice period. The notice period is 3 months. I need to resign early as I got an offer from another company. The current company are not ready to relieve me from the position before notice period. What should I do?

If the written agreement says that you may pay them if you want to leave the company without giving the full notice period, you can do so. They can't change the contract unilaterally. But practically, you can leave by giving them a reasonable period or without giving any notice at all. The only thing they can do is not to give you a service letter as they are not bound to give you one. It is highly unlikely they will take legal action against you for the breach of contract. Actually, three months is quite a long notice period unless you are a C-level employee. Some shitty companies use such long notice periods just to make it harder for the employees to leave but such conditions would be quite difficult to be justified in a court of law.

On the other hand, when you give your resignation, the company can't use you for any serious work, especially, if you are staying just because you are forced to do so because of your contract.

Just start working on the new company on time.
Take your remaining leaves, if not enough then take no pay leaves.

If both companies allow work from home, then you can do both for a couple of months (this is what we do normally)

I had the same issue and what I did was applied all the leaves under all categories and taken more leaves as "No Pay".
