    There should be a standard to govern the SAITM before they are able to produce MBBS qualified doctors. Even foreign universities which our students are currently attending to get their mbbs are still regulated by their country's medical authority and also inspected regularly by the our SLMC people. But the law of this country was rejected the SLMC's report on that matter. So what will be the next?
    I can simplify the situation by an example.
    there are hotels,pastry shops, groceries all around the country. MOH, PHI in the area are the legally approved bodies to regulate those places to ensure the quality of the goods they produce. Because the those goods they sell are consumed by the people of the country. Now the situation is exactly like court disable the MoH, PHI because one of the hotel owner and a customer complained against a PHI.
    Now, at the moment there are no one regulating the country's medical degree awarding universities. Any one of you are able to start a shop and can give a certificate called MBBS and the certificate holder can request for the provincial registration of SLMC. SLMC should give the acceptance and the certificate holder can start practice..

    It's up to the people to decide whether the decision of the court is correct or wrong. I personally do not accept this court decision because it can harm the country's health sector. GMOA should stand against it.

    Courts do not make laws! what they do is interpret the law and they are given that power by the fucking constitution! nobody cares whether you or GMOA like those decisions so try to appeal to supreme court if not successful shut up and obey the law.

    Courts did not disable anyone they said according to current law SLMC has no legal premises to deny SAITM registrations.

    Stop spreading misinformation no anyone can't just start giving MBBS certificates. they first have to get necessary permissions from ministry of education and UGC which is the authority responsible for regulation higher education in sri lanka. please don't talk about things that you have no idea.

    Secondly this called scaremongering, basically scared of loosing monopoly they held taking poor’s for a ride

    Thirdly tertiary education is not right and only elementary and secondly until 12 is a right. I do not want my tax money for these protesting students and we should have referendum about tax money spent on universities spending on these morons as the first step toward education liberalisation.

    It’s right of every student to get a decent education if Gov can not provide it and no country has been able to provide it without private sector support. Remember private sector is you and I too... not aliens as stupid JVP point out

    It's been fucked up from the very beginning. SLMC has ho legal premises!!:lol:. It's correct according to the current law. What the court did was just point it out!. Those judges disregarded the country's future and just gave the decision in favor of the parties that the case involved.

    According to you , you are accepting that the decision of the court. So SLMC has no authority on SAITM or any other medical faculty in country to decide whether they are up to standard or not. Then who are going to regulate those medical faculties? ministry? UGC?. according to the court it seems that the sole authority of the decision is up to the health minister..

    whatever it's, it seems our country is deviating from the internationally recognized pathway on the regulation of these PMCs. I think the GMOA will bring up this issue to the international level because we are not the only people will affect by this.

    It's true that this loophole in the constitution should be closed before going to a court case again.
    This is not over yet. People who are getting mbbs from foreign universities has to pass the Act16 exam before they get the SLMC provincial registration. So they are going to file a case against SLMC to challenge SLMC authority on those foreign universities too..
    It seem logical that why do foreign mbbs students need Act 16? According to the this law they can just start internship in here without an Act 16:baffled:

    Government should introduce regulations to mantain the quality of the universities. It should not only for private universities but also for all the univesities in the country.

    But think gov. Universities never challenged the SLMC s authority on them. Not only the universities but also entire health sector including the doctors, nurses, MLT and the whole systems did regulated by the SLMC. If there are any medical related issues on doctors, nurses, hospitals were brought on to the SLMC at court and their decision was the final one. SLMC held the power to register or cancel the registration of doctors, nurses, ect..

    Yes There is a monopoly of gvt. Doctors. We can agree on that. Yes it should be broken. But not in this way. Accepting the SAITM is not the way to revenge from doctors. If we want to revenge from docs then we have to make new legistlations. SAITM is not the anwswer to break the GMOA. Otherwise people with vicious intents will take advantAge on this oppotunity.

    ok.. here is what I want to say. we are now getting this thing beyond our primary topic. What I am saying is this court decision entirely wrong and it was done according to their internal agenda. What you are saying is correct but only with facts.
    If this judges wanted to give such a big decision they should allow GMOA to participate in this case. The court rejected the GMOA's reguest. It was a planned one. If the court did have a good intention then they should call for all the affected parties and the parties that will affect. you can say that judges acted according to the order of constitution. But If judges needed they could have found a pathway around it.

    Whatever it is now they gave a decision. Don't try to say that the judges are innocent. I am not saying that the GMOA is right. GMOA have some sort of bad habit on intervening everything they can see. I am not saying that the everything done by the GMOA is correct but in this situation they should act. someone should act.

    this is the most idiotic court judgement ever.. It doesn't matter that whether the judges acted according to constitution or not. They have made a decision that will affect badly on country's health sector.

It need constant optimizations with time to adapt on people's demands. That is why there is a parliament to make those changes on the constitution. But instead of closing those loopholes of this old constitution what they did was that they took advantage of those points and used it on their private benefits. That is how SAITM won the case.

    Court didn't do anything wrong I can agree for that, but also they didn't do the right thing too. The judges didn't take the responsibility and instead they gave that responsibility to the fucking years old constitution. It was done deliberately.

    If we are doing a government job we can do it in two ways. One way is just doing the job by avoiding the legal issues, or trying to do it as it stated at constitution. In this way that person do not do a service he just doing his job to get his monthly wage.

    Other way is the person who do the government job can do his job as a service to the public. By this way he may need to work against the constitution and he may take some additional unwanted risk. But he is the one who are truly giving the service to the public. He is working beyond the salary he gets.

    So we both can agree that to what catagory those judges are belongs to. They just did their job but not as a service..

    GMOA is doing the arrangements to bring an act on changing the constitution in order to Give SLMC to some authority on medical facalties in country.
