If they have reported this tree and its danger previously to any authorities and you had been ordered to cut it down, then you are in utter deep shit. You will have to do what they ask you to do and pay for....

BUT... if not...... A tree falling down due to a rain is considered as an "Act of God" where unless bodily harm or death has not been caused, you are not liable to pay any damages or claims for repairs.

Human response : Offer to pay for the labour & material of the damaged roof. Only for the part of the damaged area and if any extended damages had been caused. Its' your neighbor and you will have to live next to guy for the rest of your life.

IF they claim for more, try to talk and come into an amicable resolution... and if they are not willing to do it., ask them to fuck off !
