There is no provision which states what happens if no action is taken within one week. So if no action is taken within one week , it will not result a loss of the seat ! (my point was that argument that a person who was not successful in election cannot be elected has no basis under provisions of constitution as it stands.)

I don't think the legal system works like a programming contest. Neither you or me are lawyers. Let's wait till we hear what the Courts decides.
