According to Sri lanka constitution Buddhism need to be given prioraty, so this court case will not gona do any gud for government, court or the chief justise, whatever religion if loudspeakers turn on at 5.30 Am then how the hell people will sleep ? thats bad

But the chief justise should warn and relse the monk cus we dont want to see another issue i SL

YEAH.......Matters pertaining to faiths should be dealt patiently and carefully......Coz the CJ should remember that due to monks and other religious leaders, the people are prevented from crimes which in turn makes the work of the justice system easy.....

Firstly the CJ must issue order to arrest the IGP for not performing his duty properly by getting the relevant Police officers(if there are any Officers) who cannot arrest No Good Humbug Politicians who are ordered to be arrested by the Courts but can arrest a Buddhist priest(even though he may have been wrong) within a day while these THUGS are roaming about for days and weeks.Law and Order has gone to the DOGS.Jayawewa Sri Lanka.

A group of Buddhist Monks defied an order of the Chief Justice when they failed to respect the bench today and were asked vacate the court premises as requested by the Chief Justice.

The incident occurred when a motion filed for the bail application of a Buddhist monk charged for contempt of court was taken up before a bench comprising of the Chief Justice. Earlier the monk of the Welikadawatta temple Rajagiriya Pannala Pannayaloka thera failed to turn up in courts after being charged for sound pollution by using loudspeakers at the restricted time allotted by the courts.

Over 40 Buddhist monks failed to arise when the Chief justice and the judges of Supreme Courts walked in for the commencement of the sessions. The Chief Justice speaking to Attorney at law Kalyananda Thiranagama who filed the motion for bail told him to ask the monks to abide by the rules of the courts which any one present in courts should arise when the judges walk in.

The CJ said that if they cannot abide by the rule the monks should leave the courts.

However, the monks refused and in turn the CJ said that the motion for bail was being rejected. He said hearing will be on the due date of September 15.

Thereafter the monks left the premises.

Monks protest before Supreme Court judges

(Lanka-e-News, September 05, 2008, 8.40 PM) An emerging conflict between Supreme Court and the Buddhist clergy could be seen today (05) at the Supreme Court over an incident of remanding a Buddhist monk for using loud speakers in the night time violating noise pollution laws.
Around 100 Buddhist monks did not stand up when the panel of Supreme Court judges led by Chief Justice Sarath N. Silva arrived in the bench this morning.

Chief Justice Sarath N. Silva ordered on September 01 to produce Pannala Pannaloka Thero, the chief incumbent of Welikadawaththa temple of Rajagiriya in Colombo Magistrate Court and remand him until September 15 for not appearing before the court over a fundamental rights case pertaining to breach of noise pollution regulations.
The monk submitted a motion stating that he was unable to appear in court due to illness. But a medical report was not produced. The Chief Justice has informed to verify the facts regarding the motion today. Around 100 Buddhist monks were present in the court room where the motion was considered and the monks avoided rising when the judges took the benches.

The Chief Justice who observed this stated that the monks’ action was incorrect and instructed the defendant’s counsel Kalyananda Thiranagama to tell to the monks to go out of the court room and re-enter warning that the motion would be rejected otherwise. But the Buddhist monks remained in the seats unheeding the order.

Then the Chief Justice summoned the motion and denied bail to the defendant Thero. Later the Bhikkus left the court.

Accordingly, Pannala Pannaloka Thero was remanded until September 15.

The motion was considered by a panel of judges comprising Chief Justice Sarath N. Silva, Andrew Somawansa and Jagath Balapatabendi .

Mentioning about the incident of remanding a Buddhist monk, President mahinda Rajapakse said yesterday (04)at the swearing in ceremony of the Provincial Council Chief Ministers and Ministers that the allegation against his government over putting Buddhist monks in jail was wrong and it was a ruling of judiciary of which the sovereignty is upheld by the government. He said that he informed all bhikkus who phoned him that he would not express ideas in this regard because of this.

Meanwhile, the Buddhist monks question why the President is not bowing to the verdict given by the Supreme Court against Treasury Secretary Dr. P.B. Jayasundara.

Lanka-e-News learns that the action of the bhikkus today was in accordance with the advice of a government hierarchy.

Monk’s bail appeal refused

The bail application made on behalf of Ven. Pannala Pagngnaloka Thera – who had been remanded for contempt of court in a sound pollution case – was refused by a three-judge bench of the Supreme Court yesterday. Chief Justice Sarath N. Silva and the two other judges arrived in Court at 11:30 am but about 100 Buddhist monks who were present remain seated.

“Whoever who comes to the court should respect it. No one must break that tradition,” the Chief Justice told Counsel Kalyananda Thiranagama who was presenting the motion on behalf of the remanded monk.

“You are responsible for the disrespect to the Court. Find out who prevented the tradition of respect being maintained and inform me,” the Chief Justice told counsel Thiranagama.

Although the counsel said he did not prevent anyone from respecting the court the Chief Justice again asked him to inform him of any such person.

The Chief Justice rejected the bail application.

With the motion being rejected the monks left the court.

On Monday a Supreme Court Bench comprising Chief Justice Sarath N. Silva, Justices Shirani Tilakawardane and N.G. Amaratunga issued warrant directing the Rajagiriya OIC to arrest Ven. Pagngnaloka Thera and remand him till September 15 as he was not present in court despite the notice issued by it with regard to a sound pollution case. Accordingly the monk was arrested by the Rajagiriya police and remanded till September 15.

In a directive issued recently the Supreme Court ordered that loudspeakers should not be used between 10 p.m. and 5 a.m. for any purpose.
