This kind of terms are extremely difficult to enforce in labor courts; they are mostly used to discourage pre-mature resignations. Normally during probation periods, you dont even need to give notice unless otherwise stated specifically in the agreement/contract. Best way is to try to reach a resolution with HR. If it is not possible, just give the required notice and put no-pay leaves for the rest of the period. It is highly unlikely they will take any legal action to claim 3 months salary. Once you have given resignation, keeping you inside is actually a liability because they cant give you any responsibility to you.
